Angie’s List® Rock the List Contest—Official Rules
NO PURCHASE NECESSARY
Please read these Official Rules before participating in the Angie’s List® Rock the List Contest (“Contest”). You agree that, by submitting an entry, you will be bound by these Official Rules and acknowledge that you satisfy all Contest eligibility requirements. You may be referred to as “entrant” or “you” in these Official Rules. “Sponsor” or “Angie’s List” or “we” means Angie’s List, Inc., 1030 E. Washington Street, Indianapolis, Indiana 46202.
VOID in Puerto Rico and where prohibited by law. If you are an individual legal resident of the 50 United States or the District of Columbia, 18 years or older at the time of entry, and adhere to these Official Rules, you are eligible to enter the Contest. Employees of Sponsor and their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren); Sponsor affiliates; and advisors or advertising/promotion agencies and their immediate family members are not eligible to enter the Contest.
How to Enter
To become eligible to enter the Contest for a chance to win $2,000 (by check), you must—from May 1, 2015 at 12:00 p.m. EDT through May 31, 2015 at 11:59 p.m. EDT (“Contest Period”)—submit an original jingle to the formstack provided at https://www.angieslist.com/rock-the-list-entry, which meets each of the following eligibility criteria:
- The audio or video file containing the jingle may not exceed 90 seconds;
- The jingle must be in good taste and meet the FCC standards for content and obscenity;
- The jingle must mention Angie’s List at least once;
- The jingle, to the extent it has lyrics, must be in English; and
- The music and lyrics (if any) must be original and you must have full rights to submit the jingle and transfer the ownership of the jingle to Angie’s List.
A panel of judges from the Angie’s List marketing department (“Judges”) shall judge the entries based on the following elements:
- Quality of the recording;
- Originality of the jingle;
- Conciseness and catchiness of the jingle;
- Relevance of the message to Angie’s List members;
- Relevance of the message to Angie’s List’s goal of creating positive service hiring outcomes for consumers.
Limit one entry per person during the Contest Period. No purchase necessary.
Authorization and Release of Ownership Rights
By entering into this Contest—whether or not you win the Contest—you grant Angie’s List full ownership to the audio, video, lyrics, and music contained in the jingle as well as the jingle itself and irrevocably authorize Angie’s List, together with its contractors or subcontractors, to edit, alter, copy, exhibit, publish or distribute any such jingle for purposes of publicizing Angie’s List’s business or for any other related, lawful purpose. In addition, you waive the right to inspect or approve the finished product. Additionally, you waive any right to royalties or other compensation arising or related to the use of any such jingle. You also agree that Angie’s List may or may not ever choose to make any use whatsoever of the jingle.
You hereby hold harmless and release and forever discharge Angie’s List and its employees, agents, licensees, officers, successors, and assigns (“Indemnified Parties”) from all claims, demands and causes of action which, you, my heirs, representatives, executors, administrators or any other persons acting on your behalf or on behalf of your estate have or may have by reason of this authorization.
By entering into this Contest—whether or not you win the Contest— you agree not to infringe upon any copyright, patent, trade secret or other property right of any third party and will not disclose or otherwise make available to Angie’s List in any manner any confidential information received by it from third parties if doing so would violate his/her/its obligations to any third party. You shall and hereby agree to indemnify, defend and hold harmless Angie’s List and the other Indemnified Parties from and against any and all claims, demands (whether rightful or baseless), losses, costs, expenses, obligations, liabilities, damages, recoveries, awards and deficiencies, including, without limitation, interest, penalties, and reasonable attorney fees and costs, and expert witness fees, that the Indemnified Parties incur or may incur or suffer and that arise out of or are related to the jingle. Without reducing the generality of the preceding sentence, this Indemnity provision includes claims relating to the ownership, licensing, publicity, or any other intellectual property rights relating to the music, lyrics, audio, and video of the jingle.
The Judges shall select one (1) eligible entrant who submitted an eligible jingle and fulfilled all other eligibility requirements set forth herein to be awarded a $2,000 check. Sponsor is not responsible if the prize is lost, stolen, destroyed, or used without permission. Sponsor reserves the right to substitute the prize for another one of equal or greater value if the designated prize should become unavailable for any reason. If the prize is lost, stolen, damaged, or used once in your care, it will not be replaced. You will be responsible for paying all costs and expenses related to the prize that are not specifically mentioned, including, but not limited to, taxes, and any other expenses that might reasonably be incurred by you in receiving or using the prize.
The prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). We will award the prize to a minor’s parent or legal guardian if a minor, in any state where the age of majority is not 18, wins a prize. The parent or legal guardian must sign and return all required documentation.
If you are found to be ineligible, fail to comply with these Official Rules, your claim to any prize pursuant to this Contest is forfeited.
How to Win
The Judges shall select one (1) eligible entrant who submitted an eligible jingle and fulfilled all other eligibility requirements set forth herein to be awarded a $2,000 check, and that entrant will be notified that they are potential winners by Sponsor via telephone or e-mail. An alternative potential winner may be selected if the first potential winner does not claim the prize within 48 hours of notification or otherwise meet the eligibility criteria.
If the potential winner is found ineligible, fails to comply with these Official Rules, or fails to email Sponsor or claim the prize within 48 hours after Sponsor notifies him or her, such potential winner’s claim to any prize pursuant to this Contest is forfeited and an alternate eligible entrant may be selected as a potential winner by Sponsor, in Sponsor’s sole discretion. In such case, Sponsor will select the next eligible entrant by using the process described above and notify the alternate potential winner using the same notification process. Any selected alternate potential winner shall be subject to the same requirements for responding to Sponsor’s notification for eligibility to claim any prize.
Odds of Winning
Odds of winning are approximately 1:500. Actual odds are dependent upon the number of eligible entries received.
Sponsor may, to the extent permitted by applicable law and in its sole discretion, change these Official Rules or cancel the Contest at any time; or modify, terminate, or suspend the Contest should viruses, worms, bugs, unauthorized human intervention, or other causes beyond Sponsor’s control corrupt or impair the administration, security, fairness or proper play of the Contest or submission of entries.
Sponsor is not responsible for: (a) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Contest, if applicable; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer resulting from downloading any materials in connection with the Contest, if applicable.
Sponsor may, in its sole discretion, disqualify any individual found to be: (a) tampering with the entry process or the operation of the Contest or website; (b) acting in violation of these Official Rules; or (c) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person.
If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. If applicable, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the entrant and must comply with these Official Rules in the event of a dispute as to entries submitted by multiple users having the same email account. The authorized account subscriber is the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email addresses.
All decisions of Sponsor in connection with this Contest are final.
To accept a prize pursuant to this Contest, a potential winner must sign and return all required documentation (which may vary depending on the potential winner’s state of residence and may include waivers, releases, and other contracts related to the jingle) and shall be required to agree, on behalf of him/herself and his/her heirs and assigns, to: (a) allow Sponsor to use winner’s rights of publicity, including winner’s name and/or likeness, without compensation now or in the future, in connection with the Contest and for Sponsor’s promotional use, in any legal medium; and (b) release from liability and hold Sponsor and Sponsor Group (defined below) harmless from any loss, injury or damage to property or person, including death, and reasonable attorneys’ fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or participation in the Contest, even if caused or contributed to by the negligence of Sponsor or Sponsor Group. “Sponsor Group” means and includes Sponsor, its affiliates and their respective owners, members, directors, officers, employees and agents.
This Contest shall be governed by Indiana law. By participating in the Contest, you agree that any lawsuit or other action arising out of, or relating to, this Contest or these Official Rules shall be brought exclusively in the state or federal courts located in Marion County, Indiana. You agree to the exclusive jurisdiction of such courts.
All rights are reserved by Sponsor. The failure to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force.
By June 15, 2015 Sponsor will post the winner’s name at www.angieslist.com/rock-the-list until at least August 15, 2015.
