    My brother passed away recently. He was a homeless veteran, I was offered a low cost funeral and a contract was signed that I would owe them $1500. There was a verbal agreement I would pay $50.00 a month through a payment plan. I raised $700 from family and friends gave this to the funeral home at which time I was asked to sign a new contract allowing for an additional $300 payment from the VA. Now they are asking for the final $500 in full and will not honor the original verbal contract of $50 a month. I was told they were going to put the obit in two newspapers but it only published in one. This caused a number of people to miss the funeral.  Reply to Stith I can't believe Stith Funeral Home. Their math doesn't add up. They said that I took advantage of them and that I did not pay them. I have the receipts to prove that I did pay them. The day before the funeral the total cost was set at $ 1500.00. I gave them $ 300.00 at that time and agreed to $ 50.00 per-month on the balance of $ 1200.00 when I signed the contract. The next day at the funeral I gave Stith another $300.00. That is six months of payments. This is a balance of $ 900.00 on 8/11/2012. Later that month 8/31/2012 I signed the $ 300.00 dollar VA funeral benefit to them. That is another six months of payments also on that day 8/31/2012 I gave Stith another $100.00 cash, that was two more months in advance. This leaves a balance of $ 500 and 14 months of payments made before the first payment is due. On 10/10/2012 another $ 100.00 and two more months in advance. The balance on this day is $ 400.00 remaining and 16 months of payments made two months after the funeral. On 8/31/2013 the balance was $ 500.00 and 14 months in advance of the first payment being due. I requested a document from Stith per Kentucky state statute 395.455 for the court stating that we had made payment arrangements with Stith. This document would release my brother's checking account so I could pay his other final bills, car repair and the like. They refused. Stith refused the $100.00 and said the account was paid in full. They actually filed the court documents on 10/19/2013 in the amount of $751.00. The true Stith balance was $400.00 on that day. I called the funeral director at Stith and was told the VA had not paid and when they did they would send the check to me. But more on this later. I believe Stith could trust the U.S. Department of Veterans Affairs in the amount of $300.00. Come to find out Stith had applied for $ 700.00 in stead of the $300.00 funeral benefit due a veteran in a VA cemetery. I would have thought Stith should have known that. They had the VA think that I had asked for it. I did not authorize it. The VA sent me a letter that they had asked Stith to fax them more information documenting what everything cost to backup their claims. Stith told them that they could not give VA the information because privacy laws prevented it. I know of no such law that would prevent the VA from getting a bill for what they were going to pay for. At any rate I gave the information to VA , but I think they probably already knew my brother was buried in their cemetery. The VA denied the $700.00 request and sent a check for $300.00 on May 1, 2013. That is what delayed the benefit check. The VA told me they mailed out a check for $300.00 to Stith on May 1, 2013. I called Stith a number of times. They ignored my calls. I then sent them a letter telling them to give me the $300.00 or I would take them to court. Stith mailed me a check four months after the VA sent the $300.00 benefit for $79.88. In the Funeral agreement it states ?past due and delinquent? payment fee applies. In the letter they sent with the $79.88 check they had been charging a late fee every 10 th day of the month from 9/10/2012. They refused $100.00 on 10/29/2012 saying the account had been paid in full and would send the check from the VA to me when it came. When did any payment get behind? Did Stith charge us a fee because they fouled up the VA benefit paperwork? They even took out the $51.00 for court fees and the $5.00 certified mail fee. Two costs that if they had given me the document for the bank on 8/31/2012 as I had requested would not have been necessary. The bank is just a block away. Stith could have walked with me. The letter is dated July 25, 2013, the certified mail stamp Aug. 5, 2013 and the check Aug. 8, 2013. In my opinion when I asked for a document about the payment arrangement on 8/31/2012 they got mad. After several phone calls I posted on Angie's List 9/22/2012 how unhappy I was about not getting the document for the bank. Stith filed the papers to empty the bank account on 10/19/2012. In my opinion once the VA funds were signed over on 8/31/2013 they were clear to empty the bank account. Once again in my opinion Stith emptied the bank to punish me for the bad review. Once Stith gets the VA check the file is closed. They get $300.00 more than the total bill. In my opinion the Department of Veterans Affairs brought it back up with their request for more information March 2013. So when the check came in the first week of May 2013 they just made it my fault and used late payment fees to keep as much as possible. Finally they sent me $79.88 August 2013. A year after the funeral and four months after they received it.
