    Dept. of Real Estate, Enforcement 320 W. 4th St., Ste. 350 Los Angeles, CA 90013-1105 2549 Eastbluff Drive #207 Newport Beach, CA 92660 July 23, 2013 Dear Dept. of Real Estate, I am writing to request that HOM Sotheby���s International Realty reimburse me for $1401 in escrow cancellation fees, home inspection and appraisal fees because one of the company���s brokers, Patsy Gamble, and her client, Scott Sprick, lied on the Transfer Disclosure Statement (TDS) by checking ���NO��� to the following questions: II. Seller���s Information (B) Are you (Seller) aware of any significant defects/malfunctions in any of the following? (C) Are you (Seller) aware of any of the following: 16. Any lawsuits by or against the Seller threatening to or affecting this real property, including any lawsuits alleging a defect or deficiency in this real property or ���common areas��� (facilities such as pools, tennis courts, walkways, or other areas, co-owned in undivided interest with others) Despite an initial commitment letter to us on this property, our lender, Bank of America, ultimately declined the loan after one of its loan officers discovered that there was in fact a major lawsuit filed by the Harbor View Knolls Homeowners Association (HOA) to which this property belongs. Bank of America refused to make the loan until the litigation was settled. As a result of this concealment by both seller���s agent Patsy Gamble and the seller himself, Scott Sprick, my husband and I incurred the following expenses for which we request reimbursement by HOM Sotheby���s International Realty: Escrow cancellation charges: $674 Appraisal: $447 Inspection: $280 Total: $1401 Patsy Gamble, for her part, has herself been a homeowner in the Harbor View Knolls community for many years (almost 20, I recall her saying). The seller, for his part, and his parents prior to their death, have been homeowners in this community for nearly 30 years. There are only 64 units in this HOA, and all homeowners are privy to the minutes of HOA meetings as well as to all financial issues related to the HOA. I have provided the following documentation to support my request: a. Residential Purchase Agreement dated April 5, 2013 (delivered April 6, 2013) b. Seller���s Transfer Disclosure Statement dated April 8, 2013 c. letter from Harbor View Knoll HOA lawyer to Bank of America mortgage loan coordinator Christel Pearson dated May 17, 2013 describing law suit d. copy of the complaint filed on behalf of HOA against Millennium Building Services dated October 4, 2013 e. email dated May 17, 2013 from HOA-retained attorney Robert Ward, Burdman & Ward, San Diego to me providing a copy of the litigation report prepared by expert Ernie Orchard f. letter from me to Patsy dated May 19, 2013 (sent as email attachment) requesting explanation of the litigation g. Bank of America rejection email due to litigation dated May 22, 2013 h. cancellation of contract, release of deposit, and joint escrow instructions dated May 21, 2013 i. Versal Settlement escrow letter calculating the refund of our deposit, less cancellation fees j. copy of Versal Settlement check refunding remainder of deposit k. copy of canceled check for home inspection done by AmeriSpec l. Bank of America credit card statement showing charge for appraisal I appreciate your attention to this matter very much.     We hadn?t planned to buy our second home in California for 2-3 years, but we went on vacation there and fell in love with the south Orange County area. We decided that we would get a modest home close to the beach, one within easy biking distance to Dana Point Harbor. Then we saw it!  It was a beautiful blue and white, curved-front home that looked like a destination resort. It looked like 5,000 square feet, and it was BEAUTIFUL. 
    Terry told us it was already in escrow, and that we had to find another.  We made some other offers, but nothing
    came together.   At 9 o?clock at night on the day before we were leaving to go back to Las Vegas, I noticed on my computer that our blue & white dream home had come back on the market!  I called Terry right away, and he immediately drove over to see if we could get in (no surprise here, since Terry had been CONSTANTLY available since we started looking at homes with him).  ?No-soap?, because the lock box was timed-out by that late at night, and so we had to wait until 8 the next morning to get in.  We came back over at 8 AM, and I loved the inside of the home, too!  Terry negotiated our under-asking price offer, and by 5 PM our offer was accepted by the seller.  The home had only been back-on-the-market for less than 24 hours, and now WE controlled it!  All of the other Realtors swarming around it were just out-of-luck, because Terry had moved so quickly and skillfully to get it for us!
    Once we had the home in escrow, Terry personally reviewed every critical document BEFORE we got it.  He noticed an irregularity with the legal description that could have caused us future problems.  After lots of back-and-forth with the title company, he got the legal description revised for us (a complicated process) to avoid any future problems. 
    Terry also negotiated & managed the necessary minor repairs.  I imagine the other agent (much looser than Terry) was surprised by Terry?s thoroughness, but it was just right for us, especially since we were buying from out of the area.
    I am 100% convinced that we could not have gotten our dream home without Terry?s on-the-spot availability and his negotiating skill. (We also got it under market and under appraised value, too? but the MOST important thing was that we GOT IT! Yippee!)  It closed day before yesterday, and we?re traveling back from Las Vegas to enjoy what is now OUR new home, and I am the most excited I have ever been with a real estate purchase.  Terry?s business card promised us the best real estate transaction we have ever had.  We got what he promised (and more), AND we got the best home ever, too!  (BTW, we received thousands in what Terry calls his Buyer Cash-Back to cover our escrow and other costs? it just keeps getting better and better!)
    Terry doesn?t do all this by himself.  His Client Experience Manager, Transaction Control Auditor (his fancy names remind me of Starbucks!) and his lender are all part of the team.  Together, they provide an exceptional experience with outstanding results. His lender handled our complex financial circumstances like a pro, allowing us to make the strong offer that we needed to get the seller to accept our offer.  Without her expertise, we might have lost out to the swarm of other Realtors. 
    Hunter-Broker provided us the best real estate experience we have ever had, and got us our one-of-a-kind home.  We will recommend Terry as the very best Realtor to use to all of our friends forever!  Viva Hunter-Broker!

    Frustrated with agents that talk the talk, we wanted to find
    someone who can walk the walk. Geoff came to our attention via a friend���s recommendation.
    After viewing his profile on line, we wanted to give him a try.  I was impressed right away after seeing the
    photos he took.  He should be a pro photographer!   The house
    looked really nice.  He actually cleaned
    up the house before taking the photos.  I
    should mention that the house was tenant occupied.

    The transaction was seamless.  Geoff took care of every problem as they
    arise.  I was amazed at how fast he
    responded to our e-mails.  We live
    overseas and with the 9 hour time difference, we communicated through phone and
    e-mail.  Geoff never failed to
    respond.

    I bought my current home on Balboa Peninsula from Terry, and the process was smooth and extremely well organized. Terry also represented the seller in my transaction, so he had already made sure the home was fully prepared before he even put it on the market. The home inspection was done, he already had a clear termite report, and Terry even had a roofer inspect and make the necessary repairs to the roof (doubly unusual, since the property was an attached townhome, and not a detached single family home).

    Terry also had a title report showing clear title and the HOA paperwork was immediately available because he arranged to get that up-front, too. I LIKE this kind of attention to detail!

    I ALSO like Terry?s Buyer Cash-Back, as he calls it... it saved me thousands of dollars by more than covering my closing costs and part of my purchase. The money didn?t affect my purchase price because it was from Terry, and not the seller.

    Terry is unflappable and very easy to work with, and helped facilitate the transaction, rather than complicate it. Even small things, like having a laser measuring device on hand so we could measure the space when we were at the open house, rather than having to come back and do it later help remove the hassle of getting a new home. He also seemed to be constantly available, no matter when I called.

    Terry is very protective of his reputation, and went out of his way to make sure that everyone was ?in the loop?. It was clear from the start that Terry was a person we could all rely on, and that was confirmed again and again throughout the transaction.

    In the end, we got a very good buy, and the seller was able to move on with his life too. The whole process was comfortable and low-stress, and I will definitely recommend Terry to all my friends wanting to buy or sell.

She has a professional photographer come in, she makes a booklet about your house, is aggressive and she does everything she can do to market your home and get it sold in a timely manner.     My husband and I were initially working with another realtor who came recommended from a friend.  We were frustrasted after several days of being shown homes which were not right for us.  The homes were either in our price range but too run down, or too expensive and really too much home for us.  We felt like we wanted something "in between", but with no hope in sight.  Then we went out on a Sunday to look for ourselves, and met Jody Chapman at an open house she was showing.  Jody was sooo bright and energetic from the start, and had an incredible knowledge of all ranges of properties in the Newport Beach area.  She gave us hope that there were properties in our price range that could match our wants and needs.  We changed to her as our realtor, and this WAS the best thing we could have done!  By the next day she had lined up over 10 homes to see, and these were a much better fit to our interests than anything we had seen previously.  Within a couple weeks we had found our dream spot thanks to Jody.  She was incredibly prompt to return our calls, was responsive to our questions and concerns, and was exceptionally knowlegeable and helpful in guiding us through the whole home buying process.  She also was terrific in helping us evaluate our home for repair needs, and negotiating these in our purchase price.  My husband and I had purchased a home before with another realtor, and got such a small fraction of the service that we received from Jody.  We thought of her "WOW, this is was a realtor should be like!".  I can't say enough good things about Jody, and think she is truly outstanding at her job.
