    Before the holidays Jose Macias, owner of MB Paving, came to give us a bid on our driveway, at which time I provided him all of the City of Beverly Hills written requirements. He stated that his bid would be sent the following week. The bid did not arrive until about three weeks later after I called about it. We were interested in the bid because of their good reviews and I asked to see their contract and when the work could be done. Once I said I was interested in the bid, they advised that they made a mistake by not indicating in the bid that the permit fees, about $2K, were excluded from the bid. It took them awhile to get their contract form to me because they were unnecessarily sending it in a too large zip form, instead of a PDF. When I finally received it, I noted that it was not a fair contract, offering a 10 year guarantee but limiting any legal actions to one year, thereby negating the 10 year guarantee and other legal remedies; it required the homeowner to provide all insurance; it provided for arbitration, and it did not offer attorney���s fees to a prevailing party in the event of litigation. Also, instead of the important terms being set forth before the signatures, they were set forth after the signatures in boilerplate to discourage homeowners from reading the terms. Further, instead of requesting 10% down as allowed by law, they were requesting more than 25% up front. I advised that I was still interested, but their contract was not fair, and that I, an attorney, would be happy to draft a fair contract for their consideration. They said sure, so I took my time to draft a contract and provided it to them and asked them if they were comfortable with it or if they thought any changes needed to be made. They said the contract was fine except that they could not start the job when they initially said they could. So I agreed to a new date and was waiting for the contract to be signed and returned. After considerable delay I inquired about why the contract had not been signed and returned, and at that point, Jose indicated that he had no intention of signing the contract until he could speak to the inspector on the job. Of course that would be impossible because in order for an inspector to come out, we would have to get the permit in the name of the contractor, and if we paid for the permit and the contractor did not want to go forward for any reason, we would lose that money. I asked Jose why he had asked me to draft the contract, had agreed to the terms of the contract, and had us wait 2 months for the work to start, all the while concealing the fact that he had no intention of signing the contract unless and until he could speak to the inspector who had not been assigned. He did not have any reasonable explanation. The bottom line is that it was like pulling teeth to deal with these people all along, and Jose was not honest or straightforward, and delayed our job 2 months by having us wait for him while he was concealing that he would not be sure if he wanted to go forward on the bid he had provided.
