In March 2013, I paid Herb Mills $2,254.52 to install central AC in my mobile home. Based on his calculations of my home’s duct size, he recommended and installed a Coleman 2.5 ton condenser and coil. Although other bidders had specifically stated that the AC unit should be installed toward the center of my home for even cooling, he disagreed and installed the unit at the east end. The AC successfully cools only two rooms on the east end of my home but does not cool the west end at all, such that the way he installed it renders it unfit for its intended purposes. When I called Mr. Mills to discuss problem and ask him to move it to the center, he gave me some nonsensical technical explanation as to why that could not possibly be the problem and unequivocally stated that he I had a duct problem, specifically a "balancing issue" with the furnace and advised me to call either Coolings or Snipps, two of his HVAC competitors. When I asked why he would refer me to two of his competitors, he claimed that he did not want to work with me because I had lied to him in 2013 when I told him that I had left two messages on his answering machine that went unanswered, which I did. I can imagine no motive whatsoever for lying about having left messages and find his excuse petty. Whether he wanted to work with me or not was beside the point. I paid him to install the AC and it does not fulfill its intended purposes. He claimed that I did not pay him to service my duct work and advised me to sue him. If adequate duct work is a necessary condition for effective AC, then that was necessarily implicit in our contract. Based on our conversation, it was clear that he knew at the time of installation that my existing duct work was insufficient. So, I am out not only the $2,254.52 but also approximately $1,000.00 that I paid an electrician to wire for the AC. Based on this and my experience with him at time of installation, I believe his problem is with my ethnicity. Even though his contract called for the total in full upon completion, he demanded full payment prior to completion. When I pointed out the inconsistency of payment prior to completion and the terms of the contract, he said, “I knew I was going to have problems” and threatened to remove the AC unit. We finally settled on payment of all but $500 until completion.
