This ended up a nightmare for me and my family. My contract was with Kilpatrick Enterprises with the subcontractor being family members. The primary worker ended up contracting cancer prior to the job beginning. As time passed, it was clear that she was not competent to perform basic carpentry, plumbing, installation, etc. Due to her inability to perform the work, I had to uninstall the kneeling wall, shower pan, plumbing rough ins, shower elbows, etc. My expectation was that my work would reduce the overall cost to the project, since the contractor was providing no services ... in fact creating poor quality services that had to be removed. In the end, the contractor kept down payment of $1520 which got me some sheetrock work done well ($300 worth) and a huge headache. The contractor refused to pay the tiler and I ended up paying him ~$1530 directly, since he did a great job. Below is my last email of a few that captures much of my experience (names removed) - and my request was not met: XXXXX, Thank you for writing back. I am going to write this a little out of order, just to get the most important part up front. Although XXXXX and XXXXX provided little service and added to my efforts, I do not expect return of payment. But I firmly believe that you easily can and should provide more toward reconciling this situation. If you will correct the following items by the end of the month (April), I will not file my complaints: 1. XXXXX will not return to my home to perform any work. 2. Trim the two pocket doors to accommodate the tile (remove, trim 5/8", replace) 3. Complete the sheetrock finishing and repair closet This is a very small request. Although natural, your trust of XXXXX and XXXXX in this situation is wrong. XXXXX made some phone calls and coordinated early on, but she has been absent and in no way earned much on this job. Likewise, XXXXX has thoroughly screwed everything up - with an excuse, but I, the homeowner, have born the burden via my labor, oversight, and money. You have called me a meddling customer and you defend the meds-related incompetence and mostly retired lack of oversight. My wife’s compliance with XXXXX’s request does not imply that XXXXX did right. My wife is not a carpenter, she did not expect it to be installed crooked, I did not know the rough-ins were being screwed into sheetrock, and there is no excuse for what happened here. It should be evidence to you that XXXXX’s mind was not working right. I have avoided further details, but here are more. I have pictures on my phone that I haven’t uploaded to my computer, but I will provide with my formal complaint, if necessary: - My floors were supposed to be protected. XXXXX had one bed-sheet laid out. I have provided three canvas drop cloths to protect my wood floors and shower pan (after XXXXX scratched it). - I cleaned up after Eddie each day. I like XXXXX, but he is messy and did not clean up well - and neither did XXXXX. - The drain in the floor was cut wrong in the floor, causing the pan to sit unleveled. OEM directions were not followed for the drain. - Leveling compound was not used on the drain pan per the OEM directions. Foam was applied ONLY at the drain hole. - Vapor barrier was not used per OEM directions. - Shower pan was installed with 2x4 spacers/supports at the base and furring strips BEHIND the lip. Both directly contrary to OEM directions. I had to tear out and reinstall per OEM directions. - Shower valve and shower elbow were screwed into sheetrock and did NOT match the paired valve/elbow. Two different positions would look pretty ugly and silly. - Kneeling wall was beveled backward and was not built level. I had to disassemble and rebuild the wall. - Kneeling wall was never firmly attached to the subfloor. - 2X4s were fastened with 2” screws. I had to remove screws and use 3” ones. - Furring strips for shower sheet rock were fastened at a 3 foot distance with nails. - I cut the shower rod myself within minutes. Her and your excuses for this are wrong. - I plumbed the PVC drain into existing plumbing. - XXXXX never came to “accommodate me.” She came and was shown a series of screw ups, she acknowledged her mistakes and was very sorry. She was to continue under supervision and she did not come back for any work until the shower door was ready to install. - XXXXX bought one tile bit to install the door. There were three sizes necessary and the one she bought was not any of those sizes. - I cut away the cabinet, disconnected the plumbing, and moved the vanity for the tile job. - I cut out the sheetrock around the cabinet and removed it. - I loaded and hauled away the debris from my home. - I offered to teach XXXXX how to install PEX plumbing and install the valves. I was willing to physically work with XXXXX through the project, but she was unable to be here. - I repeatedly told XXXXX and XXXXX that her health was more important than my bathroom - and I have multiple texts to both of them saying this. I have been more than gracious and patient with them. - We have repeatedly offered prayers for XXXXX’s well being and XXXXX’s health. My wife has prayed for them while at our home. We have been encouraging to them in a Christian manner. The cost breakdown you provided was based upon their estimate. The work performed does not approach the charges. The estimate is far from the actual. Simply stated, you have taken money for services that were not provided. It is crystal clear to me that both XXXXX and XXXXX have stolen from me and that Kilpatrick Enterprises is assuming responsibility for their actions. XXXXX’s health has not caused me misgivings. She repeatedly proved herself incapable of thinking clearly through the work necessary to accomplish the job she was hired for. It would have been reasonable to acknowledge that her life’s circumstances had affected her abilities and to step down from the job without our having to dismiss her. Her health and Kilpatrick Enterprises has resulted in my loss of my capital and time. Again, If my 3 minor requests are not met before the end of April, I will issue my formal complaints with the BBB, Angieslist, etc. Thank you, XXXXX
