Member says West Palm Beach contractor didn’t deliver materials
I hired RAM Construction of West Palm Beach, Fla., to install a waterproof system on a second-floor deck — a six-step process with a 10-year warranty if I install a mat on top of the sealant. I received a quote of $2,500 over the phone, but it increased to $2,800 once owner Eduardo Mondragon came to the house. I also added another small area on my roof for $800. I signed the contract and paid half upfront for materials.
The inclusion of the mat wasn’t in the contract, but I didn’t think much of it since the warranty language was included. After I reluctantly agreed to pay the final payment before the mat was in place, the stone mason called to say Eduardo asked him to pay for the mat. I called Eduardo and told him he had no right to do this since the mat was paid for, and then he tried to talk me out of ordering the mat, but I refused. He then said he would get the mat and the stone mason could install it. Again, I refused because the stone mason isn’t certified to do so.
We confirmed installation for the following Monday, but Eduardo waited until the night before to tell me he never ordered the mat although we were in contact about it for four days prior to the install date. I was upset that he waited over two weeks to tell me he never ordered the mat.
I want a $2,000 refund and cancellation of all service agreements.
