HVAC contractor blames heating issues on poor original installation

Cold feet

COMPLAINT: Herbert Garbutt, Berwyn, Pa.

"I hired Polar Air Conditioning Co. to repair my in-floor heating system. They found the pump wasn't working, so they installed a new pump head, but it was the wrong part. They then installed a manifold, which also was wrong. This work took four months, resulting in no in-floor heating throughout the winter.

"They came back in April and said I had to replace the water heater. They should've figured that out months ago rather than nickel-and-diming me for service calls and wrong parts. I have a $3,918 invoice. Although they knocked off $120, they added a finance charge. The final bill is unfair."

DESIRED RESOLUTION: "I want the final bill settled for $2,000."

RESPONSE: Richard Thal, owner, Polar Air Conditioning Co.

"This can be compared to a car that doesn't start - you repair the engine, then the transmission doesn't work. You can't know one part's broken until you repair the preceding [one]. After installing the pump motor, we found the pump drive also failed. We couldn't know this until the motor was installed. We also noted the manifold was leaking.

"We returned to install the manifold, making sure there were no leaks and that the water was getting warm. Then the member said the floor wasn't warm enough. It turned out the water heater failed. We installed the water heater he provided, then checked for proper operation.

"We used every part we purchased, and never used incorrect parts or overbilled him. The problems resulted from incorrect original installation and lack of maintenance."

STATUS: Stalemate
