Homeowner says Albuquerque handyman bailed on building her deck

I hired Multi Handyman Service Unlimited of Albuquerque, N.M., to build a wood deck. I paid for the wood delivery from a big box store and $500 for labor. Sam [Velarde, owner] and his crew moved the wood to my backyard and then didn’t show up again for a week.

He did come by on one occasion and started framing the deck. I became very concerned that he wasn’t using pressure-treated wood for the base, and was attaching the wood to my cinder block wall instead of cemented posts from below. He planned to use regular pine two-by-fours to brace the edges against the wall instead of posts. Sam’s constant response was, “there’s more than one way to skin a cat.”

After four hours, he stopped work and requested more funds for gas and supplies and then left. That’s the last I’ve seen of him. I had two different companies quote a price to finish the deck — one tested the wood screwed into my cinder block wall, and the entire board fell off.

I called Sam, canceled the deck, and requested that he return the wood to the big box store for a refund and we’d call it even. He agreed to this, and made arrangements for the big box store to pick up the wood, but he never followed through. Now he isn’t returning my calls. I want a $1,160 refund.
