Homeowner claims Indianapolis painting crew broke their toilet

COMPLAINT: Jamie and Judy Miller, Avon, Ind.
"We had a lot of nail pops throughout our home, so we hired Thomas Interiors to fix them and paint, which they did. They also patched some extra nail pops and holes in my son's bedroom and the master bedroom. The walls they did paint correctly are good, but the walls they touched up are awful.
"They didn't use the original paint as they were supposed to, so it's very obvious there's a new color over the original paint. They also omitted several nail pops that needed repair.
"In the process of repainting the bathroom, they damaged the toilet somehow. There was a Y-shaped crack going along the bowl leaking water onto the floor.
"The toilet had to be replaced, which cost about $250. They also need to repaint three walls they patched. We've contacted them four times. When they returned my call, they said they weren't going to pay for the toilet or fix the walls."
DESIRED RESOLUTION: "They should pay to replace our toilet."

"The original quote was to repair nail pops due to siding being replaced on the outside walls only. We repaired all the nail pops and painted the walls top to bottom in these areas. They kept adding on small repairs throughout the house that weren't part of the original quote.
"I explained that the touch-ups wouldn't match the original paint color due to its age. They said this was fine and kept adding on more unpaid, unquoted work. The members checked out the entire job before we left, said everything looked great and paid the balance due.
"Three days later, they called saying we broke their toilet, and that they'd replaced it and wanted to be reimbursed for it. I explained that they should have shown me the broken toilet. At that point, I would have come and resolved the problem.
"Calling after all the repairs are finished proves nothing to me that we did this damage. I have no problem repairing or replacing any damage I know we created."
