Disintegrating driveway draws homeowner's ire

COMPLAINT: Robert Harrison, Delaware, Ohio

"J&J Asphalt Paving of Johnstown, Ohio, installed a new asphalt driveway over existing packed gravel, including adding an extra single-car parking area and an apron in front of my garage.

"The installation was plagued by problems with the asphalt applicator machinery breaking down and the non-availability of a large roller to compact the asphalt. Consequently, the asphalt was subject to additional cooling, which combined with the low outside temperatures, resulted in numerous areas where chipping occurred.

"The driveway is now disintegrating in the chipping areas and collapsing in others. The contractor maintains that a free seal coating would take care of the spalling areas, but other experts say that's not true.

"Dandelions are now poking through the driveway. Undoubtedly, it will further fail from the break-up of the asphalt caused by weeds. In addition, the asphalt is too thin. The sides of my driveway are now wavy and not what would be considered the norm for a satisfactory asphalt driveway.

"Also, the contractor damaged the lawn with large deep ruts from heavy equipment and promised to come back and repair those areas, but never returned. I've called the company but have not received a call back. My contract has a three year work guarantee."

DESIRED RESOLUTION: "The proposed resolution is to have an independent asphalt expert inspect the driveway and come up with a solution, which J&J will abide by and make the necessary improvements on within 30 days."

Wow, lots of stuff has been messed up on that driveway, that's too bad. Why do the experts say that a seal coating won't help it? It should at least slow it down, shouldn't it?
