Condo Association says Berea fence company won’t mend fences
I am a Board Trustee for Mesa Grande Condo Association and I hired Budget 1 Fence of Berea, Ohio, to replace fences for our 48 units. We paid Matt McMillen and the company $12,450 down for the job.
We noticed that he was not sending out workers to complete the repairs. Two workers did appear during the first two days of the job, but after that, there was no activity. I continued to call, but only got two workers for two more days and the work ceased again.
Our treasurer and president visited Budget and met with McMillen to request a commitment to get a full crew on the job, but he was unable to give that assurance. We hired another company to complete the needed repairs to the fence, so the work got done. Then, McMillen sent us a termination letter advising he was charging $2,750 for the work completed and would refund us for the remaining balance of $9,700 within 30 days.
Thirty days passed with no refund, so we followed up to make sure the check was coming. A month later, we did receive a $500 check, and when the treasurer followed up, the company said they’d pay us the balance in $500 increments, which is unacceptable and not what we agreed to.
When the treasurer and president again visited McMillen to inquire about the refund, he became aggressive and screamed profanities at our treasurer, a woman. We are still waiting for the $9,700 refund and are willing to accept $3,000 a month in payments until we are reimbursed in full.
