Measuring your foundation for levelness alone is not enough to determine if your foundation needs repair. A foundation expert will evaluate all the factors.

Unfortunately this is not something you will easily resolve; and even if you were to win, the amount of time and funds spent will probably exceed the cost of the actual repair.

Each state has different rules on what "as-is" means, but almost all use the term when it comes to realestate sales.  At two years, you are facing a hurdle that any issue could be the result of new conditions, acceptable wear / settlement, etc.  Has there been any changes in the area? (New house built next door, new addition, earthquake, flooding, etc?)

While you may have been given a home warranty with the purchase (do check your sales paperwork to see if there is any warranty and what it covers for how long) the house is sold to you as-is; it is your responsibility to raise concerns prior to taking over the house, so going back two years later is a huge up hill batle.

The home inspector is also going to be found faultless, as their reports almost always have words like "consult with an expert. . ." after each report section and they have disclaimers for missed items, etc. I got certified as a home inspector and was surprised at just how little they actually require you to know to become an inspector. They are really just an extra pair of eyes to help inexpereinced home owners look where most people don't look or go.  You even mention that the repair work was well masked, so you didn't notice it until you began looking for it.  A good inspector might have caught it, but you won't win any court cases proving yours wasn't good enough.

The Seller will claim that any foundation issues were fixed and resolved, which is why they marked "No" on the foundation issue section.  They fixed it; so it was no longer an issue.  If it came back, that is a new issue.  You and I know this is bogus, but to win in court you have to prove intent; and the builder can easily show they thought it was fixed.  Or, they might even be able to claim they were unaware - the repairs were from the previous owner, and were hidden so well HE and YOU didn't notice them.

So the next step is to meet with your home insurance agent.  As I mentioned above, if there have been any enviromental changes (a new house next door could have changed the underground water table flow or pressures, for example) you may be covered.  Even if there are no issues, you still may have a policy that allows for major repairs to be covered after a certian cost threshold, etc.  You'd be surprised at what your home owners insurance covers - find out first; they might have in house or low cost engineers who will do the initial inspection, etc.  They also will provide advice on your home sale; if they think you have a case against the Seller.

Best of luck on this issue.  Make sure any solution you pay for solves the cause (Stress on the wall), and doesn't just fix the results (cracks).

For this type of job, you need plans and specs from an Architectural/Engineering firm before thinking about contractors - and to get a building permit. Ben's method would work and done incrementally could cost well over $100,000 plus as he says, but this not really the most economic way to approach this big a job. A House Mover or Foundation Underpinning specialty company can usually slide your house onto a whole new foundation, or jack it up on steel beams and hold it there while a basement is dug underneath it, without any intermediate piers. The jacking/move cost would probably be on the order of $30-40,000, and a new basement probably about $40-50,000 - rough ballpark, though I have been involved in some 1000-1500SF single story jobs that went for under $70,000 total. I have been involved in a fair number of these type jobs - and the way the numbers come out, if there is room on the property to move the house, it is almost always nearly as cheap or cheaper to build an equivalent square footage (basement plus ground level) addition rather than add a basement under the house, and that way your new footage is half above ground so worth more on resale, plus you do not lose use of the house for a month or two. Second cheapest is usually sliding house to a new foundation, if property is large enough to do this - though house is totally cut off from utilities for a week to three. Most expensive, and usually only done in tight city environments or with full 2 story or higher houses, is adding the foundation in place, though your utility interruptions should be on the order of hours at a time rather than days or weeks. Talk to an architect - I think you will quickly lean towards the addition option rather than adding a basement - it is just too expensive to deepen foundations in most cases, plus you WILL get cracking in the house and possible water and sewer pipe problems in a move/underpinning job, which is not the case with an addition. This become more likely the case since you want to add 8 feet off the back of the home anyway - so why not just enlarge the addition and do it all that way - MUCH simpler, and MUCH less disruption of your life, and you get much higher resale return on your investment.

. He was right on time in a clearly marked company car and a uniform. He introduced himself and asked about my concerns. I showed him all of my concerns and he did a complete inspection of my foundation including a 360 degree walk around as well as 100% of the crawlspace. The entire time he was explaining what he was looking for. The final conclusion was that the drywall cracks were not a foundation issue just typical settlement/construction on the "long" walls of the house. he noticed a place where water pools close to the house and suggested I get that fixed to prevent damage in the future. With the 100% free inspection done he was on his way and I was relieved not to have a bigger issue, and pleased with the service provided.

Work was scheduled to start on a weekday, with crew arriving between 7am and 9am. I took off work, set my alarm for 6:45am, and then at 11:45am the crew finally showed up. The crew chief said he did not have my cell phone # (it was entered incorrectly on his sheet) and that they had a staffing problem and were short 1 or 2 guys. So they got started with the crew they had. He said yes lets go ahead and try the 2 interior piers as per the original plan. We did those 2 interior piers, they lifted as much as they could, and guess what - it did practically nothing. of house) did not seem to be getting any support from where they were lifting. Our living room floor now looked like a large shallow soup bowl, being higher on all sides, and considerably lower in the middle.

?) figured maybe they weren't lifting on a beam, or maybe I had a broken beam, or maybe I had a poorly constructed foundation or maybe they were just in the wrong spot. They said, "We can try digging a few more holes and see if maybe lifting somewhere else will help." At this point we were already running behind schedule and our house was turned upside down due to the interior jackhammering and all the fallout caused by that (moving out furniture, covering stuff up, peeling back carpet, sealing off doorways to keep out the dust....) so I said NO do not start randomly trying to guess at where the magic spot is. It will cost me more money, more time, more hassle, and may or may not even do anything to improve the situation.
In the meantime, the exterior pier count had gone up again.

and crew decided that even more were needed - I think we ended up at 30 piers outside and the 2 inside. However, our contract agreement had been that "If any existing previous piers are found after digging, and are found to be usable, we may use those existing pier footings and adjust them as needed, and will reduce $100 per each one of such piers if any are found." I asked midway through the digging if any had been found. I got very vague answers. "Yes we can tell there was previous foundation work here". And "Yes we found some existing piers". But there never was a clear answer if they re-used any existing footings or not. When I pressed about it, it was more or less decided that it would just all even out. They installed 30 piers instead of the 26 on my estimate, but "some of them" were on existing piers, so that all evened out. Or at least they say it did. Nothing was ever shown or fully explained to me on how that math worked.
I had been told to schedule a 2 or maybe 2.5 day window to have all this work completed. Because of the late start, short staffing, confusion on the interior pier issue, it dragged out to 3.5 days for completion. Even when they had "finished" I had to email

to send them back for a bit more cleanup. They attempted to clean up, but still had mud streaks on some walls and all over the porch, and a bit of trash around the yard. They had to come back on the 4th day to replace a sprinkler head they had broken, but they were able to do that while I was back at work (finally).
I was also dissatisfied with how they treated our plants in this process. They had to dig many of our plants out of their way to perform the work, which I understand, but very minimal care was taken with them. It was 25 degrees while they were digging, and they left several plants with just their bare roots lying out in the front yard for 2 days while they worked. Most of these bushes died because of this. They completely buried another 2 small bushes with the dirt removed from a nearby hole, and those never fully recovered either. I didn't expect this process to be easy on any of the landscaping, but I'm sure they could have taken more care with the plants they were working around and relocating.
A few days after completion, the independent engineer came to inspect. That went fine, luckily, even though there were obviously areas (interior) that hadn't been lifted back to where they should be. Weeks after that, I never saw the report, or any final paperwork. I was supposed to get a map of where all the piers were installed (since the actual installation differed from

original plan), and I was supposed to have a copy of the engineer's report. I had to email them weeks later to get all of that.
End result - the perimeter of our house is level, and all of our exterior door frames are pretty much square again. However, that interior wall is sagging, and our living room is bowl shaped. Because of that, the wall is now floating, and also on one side is somehow shifting down-hall also. Hard to describe, but basically while it was all being lifted, one corner of our house was also sliding towards the neighbors. So we have door frames that are now 1.5 inches wider at the bottom than they are at the top. And we have a couple of walls that are only connected from above to the ceiling joists, and not below to the concrete sub floor. Improvement from where we began? Yes. Is my house now properly square and level everywhere as I feel like it should be? No.
