"On the basis of their initial adjusters' inspection, the company paid for replacement of siding, gutters, and downspouts; and paid for repairs to the deck," roof vents, and a small part of the roof. Noting that every home around us got total roof cover replacement, we complained to the company, who sent out a "Forensic Consulting" firm's engineer for another inspection. The engineer reported some damage to the roof, but attributed it to age and deterioration. He reported that there were dents in the roof vents, but that there were no roof shakes missing. He said that there was no damage to the siding, gutters, downspouts, air conditioner, or window screens.
pointed to this report in rejecting our lawyer's letter of demand. Through the Nebraska Department of Insurance, we complained about the following: our roof was only eight years old. hardly aged; we can see one gap in the shakes without even getting on the roof; our air conditioner is under the deck and not exposed; our window screens are inside the house; and the engineer was blind to the damage to everything else, which was already admitted to by the company. The company shrugged all this off, noting that, since the engineer was hired to look only at the roof, his comments on anything else are irrelevant. We sent the company a copy of the lot plan for our development, colored to show the 155 homes out of 157 getting total roof cover replacement, and showing the two homes nestled separately among them that allegedly had only dimples in the roof vents and maybe a few split shakes. Both of these homes, ours and the other, were insured with
. The company explicitly refused to comment on that, although it would be considered absurd by the village idiot that the two homes were miraculously spared. Obviously, both the original investigators and the engineer were under pressure to go easy on
, and they complied. The engineer gave it 200 percent. As required, the company has advised us that we could go to arbitration. But the fine print in their contract frees them from any of the entailed expense, which could be several thousands of dollars. Shortly after the storm, a local TV station covered the complaints about
from another neighborhood, so we aren't alone. All things considered, shoppers for home insurance would be well advised to avoid
like the plague.

First, call your insurance company and tell them you do not want any proceeds paid to the contractor under your policy as you are not going with them.  This way they can not collect money on your behalf.  Insurance will typically have you sign a form for release of funds anyway but this is a good extra step to make sure your signature isn't forged.  Second, call the contractor and tell them you will not be needing their services afterall.  Did your husband pay a deposit?  If so it may be non-refundable.  Then follow up with a certified letter. 

 

An email as well doesn't hurt but some states don't yet recognize email as a form of communication for legally binding documentation.  This may have changed and I'm sure more states do recognize them as I haven't followed that topic elsewhere as much as I used to.  The contractor's office should be local.  A sure fire way to ensure they got the message is to deliver the letter to the office of the contractor and have someone at the office sign a duplicate stating it has been recieved and read.  There's no arguing whether they received it or not by doing that.

 

Hopefully you've learned your lesson about high pressure sales techniques and storm chasers looking for a quick buck.  Some people find out a much harder way.  While these guys may be legitimate you should always do your homework on a contractor before signing the contract.  Unless you have water running out of the house and the work has to be done on the spot it's not so much of an emergency that it can't wait until the next day.

Consider going to library an reading Consumer Reports rating on home insurance companies in your area.  For affordabilty elect the highest deductable you can stomach.  This will lower your premioum, I went thru Costco, they and Sam's Club can be a valuable resource for home and car insurance. I was very impressed with the responsiveness of the agent since I prefer to do everything through email. Best to have everything written down should issues arise. After several rounds of emails to get just the right coverages, I wanted to purchase the insurance policy. For some reason, that can't be done online, and he asked me to call him. I call the agent and he goes straight into how much I'd be paying, my payments options, all about how to get money into their bank account.
I asked him if he could provide me a final bill so that I can review everything to make sure everything is right before I hand over money. He is unable to do that. His computer will not print out a bill and even if it could, he could not send it via email. Fine, I asked him to send it via fax. He can't do that. The policy essentially cannot leave the office and his office is not anywhere close to me. He can tell me what my coverages are over the phone and if I wanted something written I could use the quote he emailed me (the quote that has asterisks everywhere saying totals are estimates and that things are subject to change).

I should've prefaced this review with my having had a bad experience with this office last year because I made the mistake of taking the agent at her word, putting a down payment on the policy, and then when I got the documents, I couldn't get anyone to correct small things or explain things that weren't on the quote. I was afraid that was indicative of how I'd be treated if I ever needed to use the insurance so I demanded to cancel the policy (since it hadn't started yet) and refund the down payment. My down payment wasn't refunded until a month later. Surprising how quick they are to take money and start a policy, but no one can seem to get it together to cancel a policy that hasn't started and refund me.
How can a business expect that customers will fork over money without any confirmation of what their money is buying???
