COMPLAINT: Kathleen and Ed Hart, St. Louis

"BK Construction replaced concrete for new front steps, sidewalk, patio and basement steps.

"The slabs on the patio were poured on two different days from different batches of concrete. The slab that was poured on the second day is a much darker gray color compared to the other three slabs.

"Our patio looks very strange. It has bleached out some with sunshine and warmer weather, but there's still a noticeable difference. We also noticed a crack in the concrete in one of the front walkways.

"We've called them [several times], and some calls have been returned, but others haven't. We're hoping they can solve our problems."

DESIRED RESOLUTION: "We'd like them to repair the crack in the front sidewalk and offer a suggestion as to how the color difference can be resolved."

"I've been working out of town, and we've returned numerous calls to the members, each time asking them to wait for warmer weather to bleach out the concrete. They said it is starting to bleach out.

"I explained that it sometimes takes several months of warm weather to work, and that we would stay in touch to make sure they're satisfied.

"Our workmanship is what we guarantee, and that was completed to their satisfaction when we completed the job. I explained we could have the concrete company owner come out and talk with them, but they declined.

"We said we can't guarantee the material because we just purchase it from the concrete company. They said they'd wait until warmer weather has had a chance to lighten the concrete."

STATUS: Stalemate
