He hasn't legally abandoned the job as long as he is still showing up and doing something, even if it is very little, from time to time.  You'll have to fire him first.  Have documentation that the job is not being done in a timely manner, showing when he has and has not worked.  Be ready for a fight and probably a legal battle since he will likely still want more money or won't refund money paid for incomplete work.


Change the locks and inform the contractor their services on your property are terminated.  Tell him if anyone representing his company enters your property they will be considered trespassing and will be prosecuted.  Then hire another company to check the work he has done to make sure it is right.  Somehow I doubt it is given the nature of his work ethic.  Then have the new contractor repair any bad workmanship and finish the job.  Keep records as any documented things that have to be redone will help your case against the first contractor.

I would recommend finding a good hearth retailer in your area and work with them to select a stove that is right for your home. They should also be able to arrange for certified installer to handle the installation. Keep in mind many areas require a city or county permit for the installation, and it may be wise to have the chimney and fireplace inspected by a certified chimney sweep beforehand.

We purchased a Big Deal for Gas Fireplace cleaning and tune up. The tech arrived on time and was polite. It turns out that the guys who installed our stone work around the gas fireplace insert mortared the door of the fireplace shut! Since the technician could not open it no work was performed. :-( The overall grade of "A" is misleading because work wasn't done but the system won't let me leave w/o giving an overall score. I don't have any reason to give them a high or low grade.

He gave us a price estimate and while we committed to the work, we did have a second company eval a few days later and found that NICTO’s cost was 1/3 of the second estimate. While the gas line could be installed on schedule, the actual logs install was delayed for a few days until the chimney work was done.

’s came promptly on the scheduled day and installed the gas line running it from the main valve, across the basement and up into the hearth, making it all ready to complete the install.

set the pressure gauge for the county test, explaining that the inspector would make sure the pressure had not varied. The county came out on schedule and found that all passed their inspection. The inspector commented on the neat job that was done and praised placement of the valves. The NICTO chimney crew came out on schedule and cleaned the interior, repaired some interior work, added the chimney cap and replaced a lot of missing brick grout. They were meticulous in doing the work, matching the existing grout color and doing a neat perfect job. They could not have done a better job.

He explained that we should have the system checked out every two to three years, replacing the sand since it can accumulate some moisture, and having everything else checked out. Both installers were very nice. They covered all of the flooring that they walked on or worked on with canvas and canvas padding by the fire place. They cleaned out the fire place ( I had forgotten some ash was in there ) with no complaint and performed their job well. I had a sense of professionalism from both installers. Everything upstairs was completely clean when they were done and I was provided with a good demonstration of the remote control and how it worked. I was told there would be some odor when the system is first started for about three to four hours (can't answer to that as it has been too hot to run) and we may want to open our windows. There was a small (some wood dust and shavings) mess in the basement when they left, actually it was very minor and no big deal to clean up. I did remove some basement junk from the area I knew they had to work in prior to their arrival. All in all it was a good experience. One thing that happened is we ended up with more expensive controller than was originally agreed to for the fire place which added to the cost that was unexpected. I was not informed by my wife as to what controller she had purchased so I accepted it. This added money to the price which just happened to bring it back to the pre-sale price of the unit. We did decide to keep it because it is better than just an on/off button.

For the first 7 years when the provider maintained our old furnace, I (a female) and not my husband, was the main point of contact. Every year, they would tell me that we needed a new furnace because ours was old. This year, when my husband was home for the first time during the maintenance, they told him.....you guessed it.....that our furnace had at least a few more years of life in it and was in great shape. Why would they tell the female one thing for 7 years, and the male something totally opposite? We decided to replace our furnace early because we wanted central air/air conditioning, and our old furnace would not work with the a/c setup. The sales rep kept really, really pushing us towards buying a ductless system. We decided for many logistical and resale reasons that we did not want one - a) there was only one place in the entire house that they could mount it on the wall, b) we didn't want to have to keep all of our bedroom and extra room doors open in order to have a/c in those rooms, c) We didn't want a separate thermostat for the ductless system, d) it wouldn't integrate with our existing furnace and home automation system, and e) would require a separate app and thermostat, which would be an extra $400.00 - and would be redundant to the system we are already paying for and use. Despite all of that, he still kept pushing the ductless system until I put my foot down. The sales rep then came out, took measurements, and looked at our existing thermostat. We specifically discussed that we wanted to keep our existing thermostat because it is part of our home automation system. When the time came for installation, the install took about half a day longer than we were told, which required that we reschedule some appointments at the last minute, and the unit stuck out farther than we were told also, obstructing us being able to open a door all the way. Then, at the very end, the crew installed a totally different thermostat instead of using the one we had. They said they had to do it because there was a "?" on the estimate where it said "Thermostat". In fact, had we not specifically asked about it and checked to make sure it worked with our existing system before they left, they were just going to give us a different thermostat and leave and not even say anything. Nice. When I phoned the sales rep to rectify this, he tried to push us to use their thermostat that would not integrate into our existing system as discussed. I reiterated, for the 10th time, that I did not want a separate system or their app. I do not WANT separate apps when I already have ONE app that does the same thing. They sent the installers out a few days later to hook up our old thermostat. They were visibly unhappy about having to come back out, and the lead installer was quite condescending to me, implying that I didn't know how to look up something on the internet via my phone. They proceeded to leave my front door wide open without asking, and we have 4 pets that are not allowed outside. They left screws and debris on our garage floor, two of which punctured my car tire. They cut a hole in our ceiling drywall and left it for us to repair. They also left behind a case of electrical supplies, and then phoned me to leave it outside for them to pick up. I left it outside for 5 days and called them twice, and nobody ever showed to pick it up. The a/c works great. We recently, 6 weeks after installation, turned the heat/furnace on for the first time. On a Saturday. It didn't work. >.< They had a tech come out, and he quickly discovered that the original installation team never turned on the gas to the furnace. Poor listening skills, sloppy and immature installation, and shockingly, absolutely no technical knowledge of the two largest home automation systems in the country that sync with HVAC systems these days. Not to mention obvious scare tactics when trying to

As luck (Not) would have it a very hot heat wave happened this week making the conditions in the attic miserable, hot, dirty but oh my goodness the crew that came for clean out was so impressive. They worked so hard, never acting like the heat or conditions were bothering them at all. We kept giving them water which they accepted, couldn't be more impressed with their work ethic. We have a single bathroom home. Our three priorities were quality, an accurate estimate and length of time. We wanted to be without a toilet for as short a time as possible, obviously.

and his crew hit all three targets efficiently and as promised. I want to say that having strangers in your home for an extended time period is sometimes a concern for people. Those concerns were simply not an issue here because all the guys we encountered were professional, polite and very easy to spend time with. I only have the highest regard for the people we dealt with at every step. The job was large but completed as quickly as possible. By the end of the second day we had a restructured, solid wood floor in place. I could easily see the work was of the highest quality and, I suspect, will last the lifetime of our home. The second two days were spent leveling the floor, prepping and laying tile. The tile used and the quality of work were better than we ever could have imagined. We LOVE our bathroom now. I have not one single gripe about any of it. Every detail is absolutely perfect. The final day brought us our toilet back and final detail work.
Every promise was kept, every original time line was met., the pricing estimate was right on and we were kept aware of all aspects of the job during the course of repairs.
