My wife and I sought bids from three contractors to build a deck and screened patio room off of our kitchen in the back of our
home.
One of the companies we called was NuSash of Indianapolis after picking up a flyer at the Indianapolis Flower and Patio Show. We called the office on April 24. They sent out

The contract called for us to pay $6,800 up front and

said he would call 811 (Call Before You Dig) and get the necessary permits to build the screen room and to bury an electrical line. Altogether,

* Construct a deck and screen room
* Bury an existing electrical line from our home to the garage,
* Construct a concrete sidewalk with brush-finish from the screen room to the garage,
* Add gutters and downspouts to our garage,
* Replace a piece of panel siding on the garage.
When it came time to make the downpayment,

I was suspicious of this and my suspicion grew when my bank called in a few hours as

tried to cash the check at two different branches of my bank. He altered the check at one of the branches to try to get them to cash it. I had to write him a new check. However, I felt comfortable enough to proceed when

came back to our house to make markings in the yard and again the next day to introduce me to his subcontractor,

. Also, since NuSash has been in business locally since 1975, I knew they had the correct contractor licenses. Since I was under the belief I was working with NuSash and just paying

out of convenience, I also felt comfortable.
I never noticed any markings from Call Before You Dig in my yard, but
Gifford Sunrooms Provider Name Locked
and his crew began work on May 12. Within a few days, the project began to take shape.
During construction, I asked

on multiple occasions to bring copies of the permits, but he did not do so.

called on Friday morning, May 23, around 11 a.m., to say that the crew only had about 3 hours left of work and that he would be there around 3 p.m.

arrived, but there was still much work to be done. The electrical line had not been properly secured for burial and was not ready to be buried.
I spoke with

about several problems with the construction throughout the project.
* I expressed concern about the pitch of the roof and he told me it was exactly what we needed: 3/12 pitch. Upon measurement
later, the actual pitch is 0.5/12, basically a flat roof.
*I expressed concern about water leaking through the roof and he said it wouldn’t. Actually, the roof leaked in multiple places. I later
realized it was due to the pitch of the roof, the shingles used and the distance of the trusses (one was nearly four feet wide!). They also didn't use flashing. Instead, they used silver tape that is often used for windows.
* I asked if the ceiling fan was appropriate for a porch and he told me it was. However, the fan blades were immediately damaged to due to the roof leaking and water getting on the blades. The fan was an indoor fan and not damp-rated.
* He told me that the existing siding on the back of my home was not painted, but primed white and he would get white siding for the screen room siding to match. I factored this into my painting budget. However did not get white siding. He got grey and said it was higher quality. It turns out my existing siding IS painted white and the grey is the standard siding.
*I expressed concern about the concrete path and the fact there are no expansion joints. Also, it’s not a brushed finish sidewalk. It's a sub-standard concrete job with a very rough exposed aggregate "finish". It's not appropriately level, it dips onboth sides in different places and will crack at the first freeze of winter. He purchased the cheapest bags of mix you can find. As anyone who has worked with concrete knows, the sidewalk needs joints for the concrete to expand and contract. Concrete contractors that I have bid to fix the walk say the concrete used is not suitable for an entire walkway.
* I expressed concern about the lack of a trim around the windows. What was done was screwing in untreated plywood over some screens. It looks like a toddler built it. His crew did not leave room for actual siding.
* I expressed concern about some deck boards that were already chipping and cracking. There were small holes too - one was about the size of a quarter - in a couple of the brand new deck boards. Even though lumber is imperfect, I felt this was unacceptable.
* I also expressed concern about the steps up to the deck and porch and that they were too high.
* The patio doors did not close properly and there was no room to caulk around the doors.

wanted a final payment from me, but the work was not complete.

, the subcontractor, told me he would guarantee the work to be done that night if I would just pay the final amount to

. He said his crew was nervous they wouldn’t get paid if

did not have time to get to the bank before Memorial Day weekend. He said the line would be buried on Saturday after taking the forms off of the concrete sidewalk.
I felt bad for the workers and I decided to write

a check. I accidentally wrote it for $6,400 when I only owed $6,000. On Saturday,
Gifford Sunrooms Provider Name Locked
’s crew did not properly bury the electrical line and left me in a dangerous situation.
On Tuesday, May 27, I put a “stop payment” on the check because: A) it was for the incorrect amount and B) the work was not properly completed.
I called

immediately and told him about the stop payment. I asked him to bring a copy of the contract, a copy of which was never provided to me until much later, and the permits.
When he arrived, he did not have the permits and he presented me only one page of the contract, the page with my signature that does not have any of the parameters of the contract such as licensing, who the agreement is between, etc. Also, he had blacked out a line on the contract. I’m pretty sure this said NuSash and I do not recall a thick, black marker line on the contract upon original signing. Also, below

’s name, he is listed as the “Marketing Representative”, not the owner. This was clearly a NuSash contract.
Earlier that day, I contacted NuSash and spoke with the owner

several weeks ago.

informed me that

told NuSash that my wife and I were not interested and that we were a “dead lead”. He stole this lead from NuSash.

came out on the 28th, I asked him if he worked for NuSash and he told me he did not. That was the first time he told me that. He said, “You were perfectly comfortable writing a check to

and Son.” His lie continued, “I made it clear that this was a
Gifford Sunrooms Provider Name Locked
and Son deal.” He did not. Presenting me with his NuSash business card, signing a NuSash contract and telling me he would work it out with

, did not make anything clear.
At this same meeting,

told me that I was the one responsible for the permits and that I was the contractor. I offered to go to Permitting with him knowing that I could not get a permit without drawings and without a licensed contractor.

left threatening to

me for writing a “bad check” when in fact, I had only put a stop payment on a payment that was not due since the work is not permitted, not finished and the check was for the incorrect amount.
The next day, I again offered to meet

at the building permits office on Monday, June 1. He agreed and he tried to get me to sign off as the person responsible for the permits with drawings that are not accurate (particularly the roof). He left off the electrical work too in the drawings. I had also been told by Permitting that I needed to obtain a permit to bury the electrical line and

insisted that I did not.

told me the drawings he had made would cost me $500 if I wanted
them.
We departed again.

on my home.
I decided to call a licensed home inspector to look at the screen room and other work. The inspector found several code violations and bad construction practices. I offered for

to meet with the inspector. He did but he disagreed with everything the contractor found except that the electrical line was not buried properly.
I agreed to pay

$3,800 as a final payment (instead of $6,000) thinking I could get the roof and electrical fixed with $2,200. I did this to get him away from my home and protect against the headache of him attempting to
Gifford Sunrooms Provider Name Locked
me. I wrote an addendum to my contract that he signed indicating that this was the my final payment.
I have since had a licensed contractor and electrician look into the room. The electrician will take care of the line burial and electrical code violations (incorrect fan type, no GFCI on electrical outlet, no cover for outlet, outlet on same circuit as fan and lighiting). I had
another contractor look into fixing the room, but he believed it was beyond repair. I have used this contractor many times for other work. He and his crew tore down the screen room and build a code-approved, sturdy room that does not leak and looks beautiful.
Also, I called 811 and there is no record of them coming to my house nor a request for my address by anybody.
I want

to pay for the cost of electrical work ($700), demolition and construction of new patio room ($4,800) and concrete path demolition and new path construction ($1,600) for a total of $7,100.

. subcontractor assigned to perform work was very courteous and competent but not particularly punctual. half of windows did not arrive with delivery so were reordered - another 2 week delay. finally finished and a leak developed at the storm door.

attempted twice to seal leak and finally decided that the gutter above the door was the problem and they did not install gutter so - not their problem, even though they did install the door. interior caulking almost non-existent and finish details are a bit rough. a project that was supposed to start 6/9/14 and be finished around 7/4/14 finally started on 6/19/14 ( after much complaining) and finished 8/21/14.

Very difficult getting county planning and zoning approval, but SDG's chief project manager made it happen. Excellent work on his part. The excavation contractor - Micke Digging & Hauling - was excellent: they scraped, dug, poured for the foundation and floors on time and did a good job, even with threatening rain. We're having them back separately to put in a new patio for us. The electrical sub-contractor -

- was excellent, with suggestions, workmanship, and punctuality. He found ways to install wire in the most difficult spots, stayed until done, and answered all questions.
The erecting sub-contractor, on the other hand, was not fun to deal with. On a

, these are the guys who spend most of the man-hours on site. The foreman was poor on communicating with us and failed to show up when we were expecting them. My wife and I took vacation days to be home, when nobody showed up. There were no apologies, just excuses. To be fair, they did a quality job when they finally finished. On the night of the 18th, we had a torrential downpour, and there were no leaks, and the room is wonderful.

Again, excellent quality, poor communication and punctuality for that one prime sub-contractor.

and the other two subs are all good. But I have to hold SDG accountable for the performance of the erecting crew.
Remember, there are two or more sides to every situation. This is how we, as the customers, experienced it. It probably looks a little different to the contractors.
