Sellers: Sell in 60 Days or We Work Free.
If we are unable to produce a ready, willing and able buyer for your home within 60 days at a price acceptable to you, the seller-side listing fee we mutually agreed to would be reduced to $0, but we would nevertheless continue to market your home for an additional 60 days.
However, the fee to the agent with the buyer (which might sometimes be us) would still be paid at successful close of escrow.
(This does not apply to Short Sales.)
Short Sales: All costs (including commissions) are paid by the bank (lender). The bank may also pay you $3,000 for moving costs.
The Federal Debt Relief Act helps avoid tax on the "wiped-out" debt (which the IRS considers to be income) thru 2012. So, a Short Sale will likely be tax-free to you. (Check with your tax advisor)
