If the state requires a contractor's license, then he needs to have a license in each state he intends to work in - plus state/local business licenses as applicable.

 

This does not mean there are not a lot of contractors who cross state lines without proper licensing - the penalties in may cases are not real severe and are just a fine, not criminal, so many take the chance.

 

As you say - argh  - many contractors are not really businessmen and have zero legal education, so many people get burned.

To overlay,with proper adhesion so it does not peel off, you first need to prepare the surface - typically heavy watercutting or sandblasting for concrete over concrete, or high-pressure presure washing and an asphalt (NOT water based cutback) adhesion coat before asphalt overlay.

 

Because of the prep cost, a concrete overlay commonly costs more than just tearingit out and replacing it, and if you are replacing it due to cracking and breaking up those cracks will almost always propogate or "reflect" through the new layer too with concrete. Ditto with asphalt overlay, though using a crack-stopper fabric can reduce (but usually not eliminate) that.

 

If just repairing ice melt/freeze thaw deterioration, a cementatious epoxy overlay can be used, though its life is less (normally) than new concrete. Usually used for limited areas like garage area pad, not entire driveways.

 

Asphalt overlays over somewhat deteriorated concrete can work well,but if not prepared and high-pressure (about 5000 psi or higher) cleaned to remove ALL deteriorated material, they can peel off because they stuck to deteriorated loose material rather than sound concrete. Again, can cost as much for a 1-1/2 to 2 inch overlay as for a 3-4 inch full replacement by the time you are done, because the prep work is labor intensive.

 

Even if this is just a surficial deterioration issue, I would talk to several contractors (site visit) about alternatives and let them bid both an overlay and a replacement (or whichever options they are inclined to bid on), then after getting opinions from all three and bids for all options, make your decision. I am pretty confident that total replacement will be both the most recommended and the cheapest, at probably about $2-4/SF for asphalt or 4-6/SF for concrete - commonly nearer the lower than higher range for most jobs and locales. If the overlay and replacement cost is pretty close,I would go with the replacement because overlays over concrete are always somewhat iffy as to how long they will last, especially concrete overlays.

 

For cost comparison, except in extreme freeze-thaw country, you can figure a concrete drive will last about twice as long as an asphalt one.

Overall this whole project was and still is a nightmare. After getting 5 different bids I went with this contractor because he seemed knowledgeable and willing to answer any question I had. His price was in the middle range of the 5 bids I received. He tore out my old driveway and sidewalk without issue. That was the only part of the job that went well.
When he poured the new sidewalk the approach that butted up to existing concrete porch was very unlevel looking right to left from the street. 2" drop from right side of porch to left side of porch. He ended up tearing out that one small section and re-poured it. When he re-poured it he failed to drill into the existing sidewalk with any anchors. So now, every winter that small slab he re-poured rises above other sidewalk when it freezes. Next onto the driveway. The main driveway was poured in 1 day. The approach was poured a day later. Contractor failed to cover the main driveway next to approach with plastic so fresh concrete was splattered onto main driveway when approach was poured. Very sloppy work and the concrete splatter left permanent stains on main driveway. Contractor reassured me he could get those splatter stains out with a pressure washer. He brought pressure washer out day later and in process of getting concrete splatter off he left permanent pressure washer stains in place. So it went from bad to worse.
When it came to time to pay remainder of what I owed him I was hesitant because of the pressure washer stains that even as a

person I could tell would never come out. Contractor assured me he would take care of the stains no matter what and insisted I pay him in full. I even had him draw up a contract showing he would repair the stains with whatever was necessary. Since 06/12 he has came to my house 2 times with a pressure washer to "prep" the driveway for a tinted sealer which he does not even know will fix the stains. He always had excuses as to when he would actually fix my driveway. These excuse went on for over 2 years. I had to have another contractor try and fix my sidewalk. The driveway is still a mess. , crooked saw cuts and approach is already chipping badly after only 3 years. I regret using this contractor but regret even more paying him for a sloppy substandard job. It was a learning experience for and I realize now I should have withheld final payment until he fixed this mess. I noticed early this year his fancy website and work email were no longer in service so I guess it is true. You get what you pay for. I hope people read this review and see what could be in store if they go with this contractor. I have pictures that I would be glad to show.

When we didn't hear back from them in October we called and they promised to have the work completed by November. My husband ripped up the walk which left a sandy and muddy mess at the side of the house for 5 months. They never showed in November but came in December to dig it out and dump stone with the promise that we'd be first on their list in the spring with more stone and to finish the job. Meanwhile, our two big dogs, four kids and ourselves were tracking in dirt and grit from the walk into the house from November until spring. I tried to minimize this by covering the area with large cardboard boxes. At the beginning of March ,after it had started warming up I called them. I tried to be polite but
