" We purchased a home built by
located in
Beach, S.C. and there have been several issues that have not been addressed." Primarily, our sod was put down in October and it never took. It actually froze during the winter months and it never grew. In addition, there have been tremendous puddling and mudding issues in the front and backyard, as well as on the sides of the house. This is due mostly because the landscaping was not grated correctly and the drainage was done incorrectly. Some months after the construction, we chose to increase the size of our patio. (We decided to add more cement so as not to see all of the dead grass and weeds.) We hired outside workers to complete the job because we've been so dissatisfied with Flagship. During this process, as the contractors dug to level the floor to put in the concrete, they were unable to continue because they found a large wooden palette in the ground. This palette caused massive puddling about two feet deep! This palette was left in the backyard and covered up by Flagship workers when they initially sodded the backyard. (Shoddy workmanship!) Our dissatisfaction with Flagship started when it was time for our 6 month walk through. We tried so many times to contact
, the Superintendent, in order to schedule the walkthrough and fix certain things. However, he hardly ever returned phone calls. It seems as though once the house was built, he washed his hands of it and has never helped us since (poor customer service!) We ended up calling the co-owner,
, to discuss the sod issue. Initially the co-owner blamed us for ruining the sod and then decided to send away for soil tests. It took over a month for them to receive their test results, which they never shared with us. We decided to send away for soil tests and the results came back in exactly two weeks, and stated that the soil was not tampered with. The co-owner then decided that he wanted to send away for more soil tests, which we never received then called us and said that the yard was damaged (blaming my neighbor) and that he was not fixing it. On
2, 2015, we drove back to our driveway to find three men on our lawn. One from their soil testing facility (
) and two landscapers from Flagship poking around on our property. (Ummm... wouldn't you call us to say that you are sending people over to look at the lawn?! ) The soil
plainly stated that the issues we are having are due to 1) the timing of when Flagship layed down the sod. He said it was because of mother nature and the sod freezing and then dying before having a
to root and grow. 2) Drainage issues and that if not fixed that we will continue to have lawn issues. And 3) that the lawn was not grated correctly and that Flagship put down practically no topsoil. We were relieved to hear the
say the reasons for these issues (which we were saying all along!); however, we have yet to hear from Flagship on how they will resolve these issues for us. So... we've had a really rough time with Flagship to say the least. It's been frustrating trying to build our home and having to see dead grass and puddles surrounding our property. We would like to get this resolved as quickly as possible, but Flagship has been uncooperative, abrasive, offensive, accusatory, and unwilling to help us.

Yes, but you won't like what will probably happen (this is a worst case scenario, hopefully you will avoid most):

The purpose for a building permit is to ensure meeting the minimum standards for construction practices and minimum safety standards.  A contractor who works without a permit, does so because they know they are not in compliance (and to save money at your expense).  They knew they should have had inspections and permits for their work.  Who ever built the addition should be reported to both the building official as well as the Better Business Bureau.  It is ultimately the homeowner who is responsible for ensuring the proper permits have been applied for, though.

So when you apply for your permit, you will be pretending as if the work is not completed (you do not hide this fact, you just have to follow the correct process as if it hadn't been built).  Your first stop will be with zoning; can you even add an addition, do you have the proper clearances from the side, front and rear property lines.  If it is a bedroom, does the septic system (perk test) support an additional bedroom.  If your building already meets or exceeds the amount of building allowed on the site or if you do not have the clearances required from the property line, your addition may be required to be removed.  There are appeal processes and variance requests you can try before tearing down the addition (Get an architect).

If your zoning review is fine, next you go to permitting.  Here you will submit plans (drawings) of what was built.  If you do not have these plans, consider hiring an Architect to generate As-Built drawings for this use.  Hopefully the plan review comes back with no changes, or you will alread know your addition is not in compliance and may face rebuilding.  Depending on the type of construction, your zoning and your local building requirements, you will be required to have inspections of your foundation / footings, the framing, the electrical, mechancial and HVAC systems, etc. affected by the work. 

This may require digging the ground back up so the inspector can confirm foundation depth, size and draingage requirements.  The interior wall finishes (gypsum board, panelling, etc) may have to be removed in some or all areas so the framing and electrical can be inspected (If one area fails, be prepared to pull all areas down).  At each inspection, if the work is found to be lacking, then you will have to correct the work before getting permission to use the room.  If there is an electrical or safety violation found, it is possible the Building Official could declare the entire property inhabitable until the offenses are corrected (IE you are homeless until it is fixed).

As you can see, you have to hope beyond belief that the builder constructed everything correctly and that the building officials will work with you to minimize the amount of deconstruction necessary to inspect the work.

Also, you will be charged all the fees associated with plan review and permitting, and you will be charged for each inspection visit (as your builder would have been charged initially had they followed the law).

As for value, here is the real concern:  If your home burns down or faces some similar disaster, your home owners insurance will balk at paying; they will blame the illegal construction as the cause.  As for the value of your building, not having a permit will make any buyer have a difficult time getting their own insurance, thus harder to sell.  The room itself will add value to your property, if it isn't a hazard (IE permitted). 

Also, taxes are based upon assessments, which use the land records.  Building without a permit, can be seen by local officials as an attempt to avoid paying property taxes, since the land records do not show the addition.  Until the official tax records reflect an accurate statement of your building, you may face fines, tax fees and other costs associated with the improvement depending upon how long it has been there unreported.

You may wish to contact a local, licensed Architect who works with the local building department.  They will know the personel, know which forms you need to fill out first and how to protect you from an overzealous Building Official (there are exceptions and options within the Code that the Building Official may forget or ignore that an Architect can request be used to prevent tear down or damage).  Next time you go to build get the Architect first to protect yourself from what this construction firm did to you.

For this type of job, you need plans and specs from an Architectural/Engineering firm before thinking about contractors - and to get a building permit. Ben's method would work and done incrementally could cost well over $100,000 plus as he says, but this not really the most economic way to approach this big a job. A House Mover or Foundation Underpinning specialty company can usually slide your house onto a whole new foundation, or jack it up on steel beams and hold it there while a basement is dug underneath it, without any intermediate piers. The jacking/move cost would probably be on the order of $30-40,000, and a new basement probably about $40-50,000 - rough ballpark, though I have been involved in some 1000-1500SF single story jobs that went for under $70,000 total. I have been involved in a fair number of these type jobs - and the way the numbers come out, if there is room on the property to move the house, it is almost always nearly as cheap or cheaper to build an equivalent square footage (basement plus ground level) addition rather than add a basement under the house, and that way your new footage is half above ground so worth more on resale, plus you do not lose use of the house for a month or two. Second cheapest is usually sliding house to a new foundation, if property is large enough to do this - though house is totally cut off from utilities for a week to three. Most expensive, and usually only done in tight city environments or with full 2 story or higher houses, is adding the foundation in place, though your utility interruptions should be on the order of hours at a time rather than days or weeks. Talk to an architect - I think you will quickly lean towards the addition option rather than adding a basement - it is just too expensive to deepen foundations in most cases, plus you WILL get cracking in the house and possible water and sewer pipe problems in a move/underpinning job, which is not the case with an addition. This become more likely the case since you want to add 8 feet off the back of the home anyway - so why not just enlarge the addition and do it all that way - MUCH simpler, and MUCH less disruption of your life, and you get much higher resale return on your investment.

Unfortunately this is not something you will easily resolve; and even if you were to win, the amount of time and funds spent will probably exceed the cost of the actual repair.

Each state has different rules on what "as-is" means, but almost all use the term when it comes to realestate sales.  At two years, you are facing a hurdle that any issue could be the result of new conditions, acceptable wear / settlement, etc.  Has there been any changes in the area? (New house built next door, new addition, earthquake, flooding, etc?)

While you may have been given a home warranty with the purchase (do check your sales paperwork to see if there is any warranty and what it covers for how long) the house is sold to you as-is; it is your responsibility to raise concerns prior to taking over the house, so going back two years later is a huge up hill batle.

The home inspector is also going to be found faultless, as their reports almost always have words like "consult with an expert. . ." after each report section and they have disclaimers for missed items, etc. I got certified as a home inspector and was surprised at just how little they actually require you to know to become an inspector. They are really just an extra pair of eyes to help inexpereinced home owners look where most people don't look or go.  You even mention that the repair work was well masked, so you didn't notice it until you began looking for it.  A good inspector might have caught it, but you won't win any court cases proving yours wasn't good enough.

The Seller will claim that any foundation issues were fixed and resolved, which is why they marked "No" on the foundation issue section.  They fixed it; so it was no longer an issue.  If it came back, that is a new issue.  You and I know this is bogus, but to win in court you have to prove intent; and the builder can easily show they thought it was fixed.  Or, they might even be able to claim they were unaware - the repairs were from the previous owner, and were hidden so well HE and YOU didn't notice them.

So the next step is to meet with your home insurance agent.  As I mentioned above, if there have been any enviromental changes (a new house next door could have changed the underground water table flow or pressures, for example) you may be covered.  Even if there are no issues, you still may have a policy that allows for major repairs to be covered after a certian cost threshold, etc.  You'd be surprised at what your home owners insurance covers - find out first; they might have in house or low cost engineers who will do the initial inspection, etc.  They also will provide advice on your home sale; if they think you have a case against the Seller.

Best of luck on this issue.  Make sure any solution you pay for solves the cause (Stress on the wall), and doesn't just fix the results (cracks).

"Like a sunroom" indicating the addition has yet to be built?  If it's just a remodel there are several remodeling contractors to choose from.  If you also need the addition built pick a general contractor with experience building new construction as well as additions.  If s/he provides a price before the plans and specifications are on paper drop them like a hot potato.  They don't know what they're doing.  Whether they have the ability to provide the plans and specifications first or they refer you to an architect you must have plans to properly bid a major remodel or addition.  It is also good practice anyway just to make sure both parties are on the same page and understand exactly what will be done.

Just a note about the "type" of contractors described in another answer.  The one's who do most or all of the work themselves are not very profitable without doing something illegal or cutting corners somewhere, if they finish the job.  The time a contractor spends on a job takes away from the office time needed to run a proper business and chase new leads to keep working after your job is finished.  There are honest people out there who do everything themselves and don't need to make much money in a year but they are few and far between, typically retired and so the work as a means to keep active and make a little side money.  Others try to do a couple of jobs at once and rob from the funds of one to help pay for the other.  They just aren't experienced enough and were probably sub-contractors who suddenly thought they could run the show.  I've seen it repeatedly.  They hit up the customer for more money due to their own budget planning or abandon the job because they aren't making any more money.  be leary of a contractor who does not either use an employed or sub-contracted crew, meaning they manage the project's quality, time, and money distribution.

The first round of painting lasted 5 days…this was just the painting of my living room, dining area, foyer, hallways and ceilings.
All repair work and painting of wood moldings was carefully attended to. All scraping, sanding and plastering ( also skim coating of one wall) was equally taken care of. Painter's blue tape was applied to all areas needing further protection. Primer plus two coats of

paint were carefully and artistically applied. Never once did I have to tell them that they missed a spot or that something needed to be done. back in March 2013. The project was to begin by the end of April. He didn't begin the project until the end of May. It took four months of emails, calls and threatening letters to finally get him to complete the job.



I have all the documentation to prove the angst that we went through with this company. I would gladly provide it to anyone who has any questions.

Zeev asked for a 50% deposit on August 12th and work started
in the apartment on August 21, 2013. Contract stipulated time frame of 3-4
weeks, which would have meant completion date of Sept 18th. We scheduled to
move from our existing apartment on September 26th, giving Zeev some buffer
time, just in case.
3 weeks later on Sept 11th, Zeev was still primarily
working on installing the wood floors,
claiming that it was "more complicated than expected". He refused to
discuss in detail the other items on our contract list, saying he needed to
"focus all his attention on getting the floors right" At that point,
we sounded the alarm bells and expressed concern that he wouldn't be able to
complete the project in time for our move (which was already 8 days AFTER his
promised end date). At this point, despite multiple requests, he still did not
provide us with design drawings of the den doors.

The worst part of this nightmare for us were the hardwood
floors. Some corners had more than 20 visible nail heads in them, there were
visible gaps between many of the planks, there were bad chips in several pieces
of the wood, there were HUGE gaps between the wood and door frames / tile
saddles that they tried to fill with an awful looking wood filler that didn't
even match the wood. (In some areas, the filler was between 1/8-1/4",
which was not acceptable by any standards!) To top it all off, despite us
showing Zeev photos of the natural floor seal we wanted for the wood, and
despite our offers to take him to our old apartment to see the floors (we
wanted the exact same treatment of the oak) -- he refused and said it wasn't
necessary, they sealed the wood with an oil/water base which made the wood
darker and more yellow than what we wanted. (We only wanted a very natural

When we saw the "finished" floors, we were
aghast... there were still nail heads that weren't even flush with the floor,
there were chips all over and very visible

all over as well. After many
discussions, Zeev admitted to us that his floor guys had totally messed out (we
later learned that he was going to subcontract it out to a professional wood
floor contractor, but at the last minute, decided to let his own guys install
our floors). He claimed that he fired most of the crew who were working on our
apartment, but that didn't do anything to make our situation better. We were
crushed when we saw the state of the floor, but at that point, there was no
choice but to move in, as the new tenants of our old apartment were already
scheduled to move in.

Apart from the floors, at some point, Zeev just gave up on
trying to design the doors, because he didn't know how to design the bifold
doors with privacy blinds attached to the doors itself. The doors never got
done.

Everything else on the contract list was an absolute rushed
job, and showed in the end result -- the paint was patchy, base moldings were
not installed well (at our front door, they stopped the base molding 2"
from where it should have continued!), electrical work was incorrect (they did
not run the cable wiring correctly into the den), dining pendant light was not
centered over the table, toilet bowls were not installed correctly (very
wobbly), shower baskets were not installed parallel to the floor, sagging
sliding cabinet doors were not fixed well, our TV

the list goes on. The first night we were in the apartment, Zeev's guys had
painted shut our air conditioner unit cover, so we could not turn on the A/C!
The only 2 items on the list that Zeev managed to complete with no mistakes
were installing the pot racks and replacing 3 shower heads. EVERYTHING else
that he and his crew touched, because an issue that had to be resolved. It was
an absolute nightmare that caused my husband and I many sleepless nights of
worry and angst.

We moved in on September 26th as planned. My husband had to
take time off from work to help Zeev project manage the work, else nothing
would get done before we moved in. Despite multiple requests for NO PAINTING to
be done the day we moved in, because of our 3 month old daughter, we arrived on
9/26 with at least 5 paint cans all opened and guys still feverishly painting
base moldings / walls / doors etc.
It was extremely shoddy workmanship that we got from Zeev
and his crew. Paint / grout was splattered all over the place, grout was the
wrong color (they had to re-grout about 1/4 of our existing kitchen tiles, and
didn't even bother to match the grout to the existing grout color, so 3/4 of
our kitchen had grey grout and the 1/4 had white grout!!), paint was extremely
patchy in many areas. When we moved in, there were still wires hanging out from
sockets! Thank goodness we had a young baby and not a toddler running around.
After a week in the apartment, we found SO many issues with
the wood floors and rest of the apartment, that we had no choice but to move
out (yes, with our 3 month old baby) into a hotel to give Zeev a 2nd shot at
fixing the floors (and other issues). The floors needed to be repaired -- some
planks replaced, filler to be corrected, resanded and recoated / resealed. It
was a nightmare packing all our stuff again. And it was a nightmare sanding the
floors with all our furniture already there. They did the apartment floors in 2
parts, and had to move around all our furniture to be able to work on the
floors. We were forced to stay in a
Manhattan hotel for 8 nights in total...extended by a day because once again,
Zeev failed to deliver. Once again, work was not getting done, no one was
project managing the work and my husband and I had to oversee the work to
ensure things got done. Even then, it was only the last 2 days that Zeev
provided more men to work on our apartment and RUSH everything again. We moved
into the hotel on Thursday, and found out on Saturday that Zeev and his team
did not even work on Friday, because they had another project to work on...
While we were staying in the hotel! It was incredibly difficult being stuck in
a 250sf hotel room with a 3 month old for 8 nights, especially when we realized
that Zeev did not work on one of the week days. This was his

things right for us. He was so apologetic that so many things had gone wrong
with our apartment, and promised to make everything right this 2nd time, but
again, he failed to deliver.
To exacerbate the situation, when his crew were moving our
furniture around, they damaged our brand new wood dining table, damaged 1 of
our brand new dining chairs, lost 4 of our throw cushions on the couch,
scratched 1 of our kitchen cabinet doors and damaged 2 of our built-in
cabinets.
At the end of the day, Zeev was not upfront with us about
timing, he claimed it would "all get done in time", with full
knowledge that it would not. He also cut corners by NOT subcontracting out the work
to the right people. The quality of his work is extremely low (and he actually
thinks it's acceptable!) -- even our family and friends who have come over to
the apartment remark that the workmanship looks extremely shoddy. We poured our
life savings into buying this apartment, only to have Zeev and his crew make a
mess of it. It is extremely disappointing and heartbreaking for my husband and
I to witness how callously they have treated our apartment. And we are the ones
who have to live with Zeev's mistakes -- there are still dents and chips in the
wood floors, some wood planks are uneven / squeaky, painting still shows blotches, poor edging,
and patches, base molding is still uncaulked in many sections, damage to
build-ins still show despite Zeev's repair attempts. We now have to pay someone

molding and floors (gaps all around!), paint touch ups (hand prints can be seen
on some doors!) etc.
Overall an extremely disappointing experience. Hiring

was one of the biggest mistakes we have made. We tried to be as supportive as
possible, providing Zeev with clear expectations from the start, with
"to-do" lists. Anytime he needed us at the apartment, we were there,
so as not to delay the work. But Zeev could not deliver and should never have
promised to complete the work in 3-4 weeks if he was not able to do so. The
fact that toilet bowls and shower baskets could not even be installed correctly
is very telling of the kind of work

does. Zeev is incapable of properly
project managing a project and figuring out what needs to get done when, in
order to stick with promised timelines. Zeev failed on so many levels -- in
terms of being trustworthy and upfront, keeping on schedule, and providing an
acceptable standard in terms of quality of workmanship.
