"It has been 152 days since I entered into contract with
(WW) to install 9 windows and one patio door. To this date, I still have an improperly sized window" in my master bedroom that does not lock and a scratched pane on the patio door, along with the wrong Interlocker piece (I think that is what the installation manager called it) and I still do not have fascia repaired or window mantles installed. However, DESPITE THE WORK NOT BEING COMPLETED I realized yesterday that my credit card has been CHARGED THE FULL AMOUNT. Below is the timeline of my experience with WW, dates are mostly exact but had I known how unprofession, untimely, unresponsive WW would be with me I would have kept very detailed notes of my experience with them. As a customer, I do not think the
should be on me to do all the follow-up to ensure things are done properly - the business should bear most, if not all, of this responsibility as they are the provider of services to this paying customer. Here is what has happened and why I give WW an F: April 18 – Enter into Contract and told 4-6 weeks to installation May 19 – contact
(salesman) to check on install date; no communication from WW since entering contract and paying half of total cost TAKE OFF WORK for 1st INSTALLATION DATE (I can’t find anything in my documents reflecting this exact date) – advised by install manager that someone leaned something heavy against patio door and broke it in the warehouse; told that two windows were ordered/received without grids and would have to be reordered; told that if the window mantles were installed as contracted (flat capped) that it would allow water in behind the window and cause water damage to the existing wood. Was told by the installation manager that he would advise of all issues and a 2ND INSTALLATION DATE WOULD BE RESCHEDULED. The installation manager showed me a sheet of paper and said that he was not going to ask me to sign it because the work was not completed. June 13 – Told by WW that they would not install fascia and window mantles as contracted, I contacted
to have him resolve issue. Advised installation manager said a Flat Cap over the existing window mantle would cause water damage to the existing wood. June 26 – Still no communication from anyone at WW, I contact
who calls me as requested on June 26. He leaves me a message saying that he believes all siding/window issues resolved and that the install date is Monday, June 30. June 30 – I TAKE OFF WORK AGAIN for 2ND INSTALLATION DATE and patio door is installed BUT the door was ordered wrong – the order should have been for the door opening L to R, but was ordered R to L. Scratch on solid pane, wrong interlocker b/c wrong door ordered. Windows with grids installed, mstr bedroom bottom sash too big and will not lock. Told by install manager that the scratched window pane was a refurbish and would be replaced with a new one, a new and correct interlocker piece would be ordered and new correctly sized window for bedroom would be ordered. Installation manager rigged patio door/interlocker piece while the correct piece was ordered. Patio door installation damaged door trim which had already been paid to be painted by painter. Had to repay painter to repair.

to check on install status and tell him again what needed to be done: mstr bedroom lower sash too big and not locking, pane of sliding glass door scratched and was told it would be replaced, rigged interlocker and was told correct one would be ordered and installed, and told him I wanted to have a keyed lock entry for the patio door.

still not contact from WW regarding 3rd INSTALLATION DATE

18 – TAKE OFF WORK AGAIN for the 3rd INSTALLATION DATE to have mstr bedroom window and patio door parts installed and no one shows up/no one calls to cancel

calls and says last part ordered will come into warehouse on Aug 6
25 – told by
that the fascia/window mantles were being ordered and that the 4th INSTALLATION DATE would be on my off day so I would not have to miss any more work. Juyly 26 - September 9 - no one contacts me from WW regarding the 4th INSTALLTION DATE to install fascia/window headers or replacing patio door pane, interlocker or mstr bedroom window or keyed lock for patio door. During this time I noticed that the patio door left corner was coming apart. Sep 9 (tues)
WW – told window headers ready and want to come out and replace trim and window headers on 9/18/2014 Sep 12 (fri)
with WW – no stated reason why calling Sep 15 (mon)

Window install follow-up call to see if I was satisfied Sep 15 – WW processes balance of contract charged to my credit card even though work not performed Due to my work schedule and work travel in different time zones I have not called WW to complain every day to make sure they held up their end of the contract, frankly complaining takes energy and time both of which I have little of and what time I have I don't want to spend complaining or compliling telephone voice mails and text messages as I have had to do this morning - however the last straw with me is charging me for sevices not renders which not only violates the KRS Theft Statues but also is a breach of contract ripe for a civil claim. I have had two friends that wanted their windows replaced and initially I had recommended WW but know that they know my experience they will be using someone else, this may be the best example that you get what you pay for - yes, WW was one of my cheaper bids but I had I known the service, professionalism and lack of customer service/responsiveness would have been this horrible I would have paid more to deal with less hassle and to be a satisfied customer. I am contacting
this morning to advise him to have WW return the charge to my credit card since the work has not been performed and will gladly update this site to let you know when the 5th, 6th and 7th (who knows how many more) installation dates are - maybe by 2015 my windows and patio door will be properly installed!

estimate was more than fair and less than the other estimates from the basement dry proofing companies. The basement was one of those that used to be a garage" entrance. So he tore it all out and built a concrete wall and attached that wall to a new retaining wall right outside the building. He also installed a sump pump and a drain and had to fix the main drain. It became very complicated yet he remained calm and knew what to do. He only charged me for parts on the old drain as it was not computed into the price which was fair. He showed up at 7 every day and worked till 6pm until the job was complete. He hauled away all the debris. He kept me informed of the progress and of the decisions that had to be made. Now I have a much safer sturdier rental property with a dry basement and a new retaining wall for a fraction of what the waterproofing companies charge just for the waterproofing.

Hello - I hope my answer will help point you in the right direction.

 

The reason you're having a hard time getting clear information is because there are hundreds of companies saying their window is the best. There are probably millions of different features you can choose to have for your windows and in price ranges from $169-$1200 (per double-hung window).

 

I've been in the business for 15 years and have seen many different window products from many different dealers and manufacturers. This all comes down to: "what's important for you and your home?" If you want a strong warranty from a company who has a full-time service department to give you piece of mind and service your windows should needs be, or are you looking at only those companies who offer true wood interior windows that you can paint or stain to match the home decor? Whatever is your hot-button, then that's where you want to start.

 

I would recommend you first choose how you want your new windows to look. Wood-interior with vinyl clad is only offered by certain companies, while there is a vinyl woodgrain finish to give you similar results without the maintenance. If you're only looking for a white interior and don't want the maintenance, a fiberglass or vinyl window would be the best choice from what is offered in the market today (vinyl will be less expensive - not necessarily cheaper quality). If you are going to change out a window to a french door and a door to a window, then you WILL NEED to find a contractor with some carpentry experience. Some companies will tell you upfront that they do not handle those sorts of remodeling projects due to the complexity and time it would take to get it complete.

Get your roofer back out there.  Course of shingles above the window need to be pulled, self sealing flashing, drip caps, and counter and step flashing are going to be required here. 

 

This is a flashing issue as the window connects to the mansard roof surface. 

 

Condensation and a leak are two different and very noticeably different (i.e. volume) things.

 

Flashing and roofing on Mansards can be tricky but is sounds very much like a roofing issue.

Much easier to scratch and typically not as good a finished quality as compared to glass.

 

Benefits are the resistance to breakage as mentioned by LCD.  Any glazing shop should be able to re-create that panel.

For a broken window (or leaking seal in multi-pane unit), for a standard roughly 2x3 foot window, can run from low of about $75-125 for single pane to more like $200-300 range for triple pane, depending on construction and any special ultraviolet or heat reflective coatings. If a removeable window unit, of course cheaper to remove it and take to replacement glass place then have them come out, measure glass size, order glass unit, then come back to install.

 

If taking in yourself, commonly they can do single-pane in an hour or two, but count on a week or so typically for sealed double or triple pane unit to come in, so you will have to seal the opening in the interim. That is an advantage of having them come out - they measure and determine type of unit on first visit and can seal with tape and plastic sheeting (if you have not already done that), then come back with new unit and install a week or two down the road - but you are not stuck with an opening in the wall for a long time.

Do you have any other data on them?  Air infiltration, Design Pressure, Visible Transmittance, and Condensation Resistance are all good evaluators.

If you are being sued and/or counter suing, then you should hire a lawyer.  While you can do small claims court and sue without a lawyer, the Contractor's insurance will provide him a lawyer to defeat you.  Plus, odds are good the Contractor has more court experience than the average Home Owner, especially if this is his standard opperating procedure.  If you go against a lawyer, you will lose, even if you are right (Saying the right thing at the wrong time is very bad in court rooms.  Get a lawyer who knows the processes).

Once you decide you are suing, there should be no further contact or access to the property with the contractor.  If you have already been told you are suing, you should stop all access to your property (you are allowing them to gather evidence AGAINST you.  Your lawyer may be able to reach an agreement outside of court to allow the contractor to fix the work within a specific time period, but even then make sure you are not in contact with the contractor.  Anything you say, will be turned against you ("The Home Owner said it was okay.")

A building official has no legal obligation in court; his job is safety and minimum construction requirements as allowed per Code.  He has no say over materials and methods, and cannot assess damage. (IRC doesn't have a requirement that the door you mention exceed 35", so he won't care it isn't 36" as an example).  What he CAN do is state if the work is unsafe or causing other conditions which are unsafe.  Let your lawyer decide; but it is not in your best interest to have the Building Offical inspect with the contractor.

To sue you need to show damages.  Get another contractor (get some references or hire an architect to help ensure you get what you need) to inspect the work and give an estimate to repair.  The amount the contractor(s) estimates becomes what you seek in court (plus court fees) from the contractor.  If his work caused problems, you should be suing, not sued.

Also, be aware that no door manufacturer makes an actual 36" door (as an example).  They each have their own frame sizes, so a "36 door" in reality will be 35 7/8" to 35 3/8".  Each door maker has slightly different sizes (go online, you can see Pella, Anderson, Kolbe-Kolbe, etc. have their actual sizes available for PDF downloads).  If you replace a Pella 36" with an Anderson's 36" they won't fit perfectly.  In fact, the different styles within the same manufacturer are sometimes even different.  The purpose of trim is to hide the gap between the wall and door frame, so your door may be perfectly fine in size and method of installation. 

When you have this work corrected (and for any future work) utilize the services of a lisenced Architect.  They will oversee the work, review requests for payments and document existing conditions and conditions found during construction to prevent the situation you are now in.  They will also ensure the proper permits are filed and the inspections called for.  Because they are a third party to the agreement, they can be the 'bad guy' and make the contractor perform, where you just have to pay the invoices they approve.  The contractor deals with the Architect (and vice versa) and you get the project you wanted. The cost of the architect would have been around $3,200 and is minimal compared to what you are dealing with now, the peace of mind is worth it and architects often find cost savings that go directly back to the Home Owner.  When you account for time alone, you will have spent more than this on just preparing and attending the court case.

Because this is headed to court, stop all communication with the contractor and get yourself counsel.  Good luck.

We sat on my patio and discussed the windows and was informed in no uncertain terms that them mentioning the $189.00 window was a ploy to get people to make appointments ... or in order words to get their foot in the door. I was upset to say the least, since I was on a fixed income. I tried to contact

I was told by the person that came to give me the estimate that this is something they do all the time and they have asked the owners to stop it because the people (like myself) are getting upset. I do not want to give his name because he was honest with me and truly a nice person. If a company is willing to lie to a consumer from the first telephone contact.. how can anyone ever trust them The estimate ended up being double the $189.00 per window and that was removing the $150.00 window disposal fee. I have contact the attorney generals office, consumer protection and my next stop will be the better business bureau. This company needs to be stopped for consumer fraud.

He was professional. Installer removed 5 old windows and installed new ones. He cleaned up well after himself.
Installer worked hard. It took part of the day.
Only suggestion: needed two installers on this job since some windows were on the second floor and hard to remove....More /> We have read that these are budget windows. It's been about two months, so far we are pleased with the windows.
Our old windows were from the 1970's and so drafty and foggy that almost anything would have been an improvement.

They did it totally wrong and and when the neighbor pointed out that the drainage is supposed to be going downhill and in the back they did not listen. I do not know if they were saving 50 dollars by not doing correctly but it is as if they switched the gutters around and had them drain the wrong way on front of our house right into our foundation. When we called them and told them they had done it completely backwards.....they did not care at all......we had pictures of all the water that was pooling at our front sidewalks up to the house and into the neighbors front foundation, we had the guy that lived here for 10 years tell them they put them on wrong.......they said they put then up the way they were before but they were lying and refused to fix the situation or even admit to it..........This company is a joke and they have no idea what they are doing, I would not hire them to do any job. I cannot believe how rude the owner of the company was and that he was satisefed with the job he did. This guy should not be allowed to have a contractors license if he thinks gutters should pool water into your foundation, that is just plain idiocracy!

We needed to have windows replaced. The guy didn't contact us for a long
time with the estimate even though I had called and elft a message.
Then when he did call the price was really high. He had asked me about
other quotes I had gotten and stupid me I told him of another quote. His
price was within $250 of the other quote. What he didn't realize is the
first quote was for windows, a door replacement and siding. When I said it seemed high for
windows his response was "It's the same as company X" I was appalled he
based his quote on what I had told him. ICK
I wasn't going to let them do the work after that.
