Unfortunately this is not something you will easily resolve; and even if you were to win, the amount of time and funds spent will probably exceed the cost of the actual repair.

Each state has different rules on what "as-is" means, but almost all use the term when it comes to realestate sales.  At two years, you are facing a hurdle that any issue could be the result of new conditions, acceptable wear / settlement, etc.  Has there been any changes in the area? (New house built next door, new addition, earthquake, flooding, etc?)

While you may have been given a home warranty with the purchase (do check your sales paperwork to see if there is any warranty and what it covers for how long) the house is sold to you as-is; it is your responsibility to raise concerns prior to taking over the house, so going back two years later is a huge up hill batle.

The home inspector is also going to be found faultless, as their reports almost always have words like "consult with an expert. . ." after each report section and they have disclaimers for missed items, etc. I got certified as a home inspector and was surprised at just how little they actually require you to know to become an inspector. They are really just an extra pair of eyes to help inexpereinced home owners look where most people don't look or go.  You even mention that the repair work was well masked, so you didn't notice it until you began looking for it.  A good inspector might have caught it, but you won't win any court cases proving yours wasn't good enough.

The Seller will claim that any foundation issues were fixed and resolved, which is why they marked "No" on the foundation issue section.  They fixed it; so it was no longer an issue.  If it came back, that is a new issue.  You and I know this is bogus, but to win in court you have to prove intent; and the builder can easily show they thought it was fixed.  Or, they might even be able to claim they were unaware - the repairs were from the previous owner, and were hidden so well HE and YOU didn't notice them.

So the next step is to meet with your home insurance agent.  As I mentioned above, if there have been any enviromental changes (a new house next door could have changed the underground water table flow or pressures, for example) you may be covered.  Even if there are no issues, you still may have a policy that allows for major repairs to be covered after a certian cost threshold, etc.  You'd be surprised at what your home owners insurance covers - find out first; they might have in house or low cost engineers who will do the initial inspection, etc.  They also will provide advice on your home sale; if they think you have a case against the Seller.

Best of luck on this issue.  Make sure any solution you pay for solves the cause (Stress on the wall), and doesn't just fix the results (cracks).

     There are two types of cracks in foudation walls, horizonal and vertical. The vertical is from settling and usually is not that bad a repair onec the settling stops or the cause is fixed. A horizontal crack in my opinion worse unless it happened right as the house was built and it was backfilled incorrectly. That should have been fixed at that time though. Horizontal cracks are a sign of lateral pressure due to either a water problem, improper wall sizing or a combination of these. In these conditions I have always felt complete excavation outside the wall and reconstruction is your best approach with the proper sized block or concrete wall with buttresses as needed.

     You mention the future sale of the home and I would think the total replacement would be the best way as it will not leave any red flags. The steel plating would point to the problem and I can just think of all that would go through a buyers mind. Little things like how long will it be before the plate rusts out and needs to be replaced, even though it would probable last a long time.

     I would think you should spend the money on a consult with a structural engineer and get a written report on the problem and his recommendations as to the best repair. It will help with any future sale of the home. Without drawings the consult should be less than $500. I would bet he would recommend total replacement.

I hope I am reading the question correctly.  By added work, I assume you are speaking of change orders or additional work as opposed to the original work he contracted for? I think there are very few occasions that it would be wise to pay a contractor in full up front for work on the main contract that you are hireing him for. BUT, It is quite common that a general contractor will charge for (and should be paid), all change orders 100% upfront, as changes are typically very disruptive to a building process. Charging up front is somewhat to discourage changes as well as to not make the builder deal with chasing after money at least if he has to work quickly to modify his schedule due to the change at hand. It should have been spelled out in his contract with you prior to the start of the job that that was the agreement for how changes would be handled.

 

Some unscrupulous customers can also contract for work that they don't actually have the money for and then it puts the builder at a disadvantage at the end of the project when trying to collect. so basically doing a change is a courtesy so paying changes up front is part of reciprocating and extending courtesy back.

 

Also, check with some of his references and referral customers and find out if they too had the same experience and see if it worked out ok for them.

I had a number of plumbing leaks under my foundation (which would require tunneling under the house) as well as wall shifting and cracking, some of which was severe. There had been foundation work around the perimeter of the house (performed by a different company) before I bought it and now my house was sinking in the middle. I got bids from a number of different foundation repair companies, but couldn't settle on anyone. I decided not to use the company who had done the previous piers and I definitely wanted someone who had their own in-house plumbing repairs as I didn't want to get caught between two contractors if something went wrong.

Golden was very prompt and professional, and was able to fix my garage floor entry seam in less than the estimated time. They knew what they were doing, wore protective goggles when performing the cutting and grinding work, and used top quality fast-drying cement to finish the job a day earlier than expected. The end result was exactly what was looking for. Two things stand out as less than ideal issues from the job - the price, and replacement to an irrigation hose damaged during construction. The price was nearly double what I hoped to pay. But I needed the job done now and trusted the Angie's List recommendations. Golden did a good job completing the necessary repair in less time than expected, and were totally professional to deal with. I just thought the price was way high. During the project, an irrigation hose was damaged. Golden replaced the hose but did not tie it into the system properly, requring me to fix it myself. They deducted a small amount off the final price for my trouble. All in all, I would use them again and recommend them to others. I would just try to negotiate on the price up front next time.

for our home foundation leveling. They indicated that they would have to drive 12 to 20 pile into each pier location. The initial crew showed up and started the job. This crew cut the root ball around the shrubs VERY small. That may not have been a concern except as they were doing the work on one side of the house they cut into the gas line. They told me they could not work at my house until the gas line was fixed, so they left my house to go to another job, leaving the shrubs in the sun with no soil on the roots to dry out despite me wetting them regularly. They showed the next day to finish the job. They finished digging the pier location and driving the pile in less than 3 hours and started leveling our house. They finished this despite the fact that I observed one of the piers installed with less than 5 piles. In this process they broke the water line to my house as well as several of my sprinkler heads. We proceeded on. They leveled one side first and we check all the doors and they were great. They then did the other side of the house. The main crew left in a hurry to go to another job leaving a couple of guys to fill in and clean up. Their version of clean up was to stack all the clay against the house as high as necessary to just call it level. Some of the rest was piled up against the fence with a promise to pick it up the first of the next week. The result of the level of the second side of the house resulted in a shift in the foundation on the other side of the house that "was" level and the doors no longer shut correctly on that side and we developed new cracks all in an afternoon.



After several days of calls we were able to get the attention of the ownership and they agreed to correct the issues. Here is where Allied stepped up. They sent a crew which I would rate as their “A” crew out. They added piles to each pier and releveled the house and kept me fully informed as they progressed. They cleaned up the yard. The only issue I had was they move the dirt from against the house and added it to the pile against t the fence with a promise the office would send someone oput the first of the week to pick it up. The office agreed to pay for the shrubs they killed and after 2 months they finally picked up the dirt.



Allied is a competent company but like many need oversight. This includes requiring adequate root balls extracted for the size of the shrub, a pile count for each pier, a plan for excess dirt removal and final inspection of the house BEFORE the crew closes any pier.

The provider told me he would meet with me on Monday August 25th at 5:00 PM At 5:03 PM he called me and told me he was running late and would not meet me until 6:00. At 6:20 he arrived and we agreed on a price and a date for him to start. I confirmed with him the next day via text that he was going to do the work for me. He said yes but he needed to arrange his schedule and he would get back to me. Two days later he had not gotten back to me so I sent a text again and he said he would definitely do the work on Tuesday or Wednesday. Tuesday and Wednesday went by and I never heard from him. I sent him a text again and he said he would for sure be at my house the next morning. The next morning came and I did not hear from him so I sent another text. He said he was on his way and would be at my house in one hour. 8 hours later I sent him another text and asked where he was. He said oh I got tied up but will come to your house at 8:30 tomorrow morning for sure. The next morning he sent me a text and said he sent his crew to another job but would try and come by later. I told him if he could not come by today the deal was off and he said fine and goodbye. He strung me along for over a week and a half and was very rude in the end. I should have listened to the other horrible review he got on Angie's list before I considered using him. Lesson learned.
