2012, we contacted
transportation and hotel accommodations in Ghana,
airline reservations for us at a guaranteed fare, if we were able to send a
cashier’s check for $4713.00 in 24 hours, which we did. On January 11, they informed us that since we
did not yet have our passports, they were unable to make the agreed upon
airline reservations, and that the fare was now subject to change. The next day we emailed a request to have our
funds returned and once we had our passports we would revisit the air fare
situation and availability. During a
phone conversation on January 14,
same day we emailed the following:
“Effective immediately, please cancel our request for airline
reservations to Accra, Ghana leaving March 21, 2013 and returning March 31, 2013
on American Airlines. Therefore, please
return our cashier’s check in the amount of $4713.00 as soon as possible.” This wording was used to accommodate Ms
business transaction once all the necessary paper work was complete. On January 28, we received a refund of
$4,241.70; a 10% cancellation fee was deducted from our original amount.
It is now
“cancellation” in our refund request was solely to justify invoking the
“cancellation fee”. Our contention is
that since we received no benefit from delivering the initial payment of $4713,
no actual services, reservations, or guarantees were provided and therefore there
was nothing to cancel. I reiterate that
at the time this request was made, we fully intended to resume our business
finalized, but did not feel comfortable leaving that large a sum of money in
their possession while receiving absolutely nothing in return.
It was the most expensive visa I've ever gotten, but with all that was involved -- the governement fee itself, the delivery of documents back and forth between cities, getting the invitation, and knowing how to do it within the necessary time frame....It was well worth the cost.
