Newark-area homeowner claims he paid contractor too much
COMPLAINT: Michael Capone, Short Hills, N.J.
"I hired Kennedy Paving in Spring Valley, N.Y., to repave my driveway. Overall, it was a terrible experience. None of the work was done to the agreed upon specification. I had to have them come back several times. They paved over an active drainpipe, and the asphalt is now crumbling. The contractor missed or was late for several appointments.
"They insisted on being paid cash in advance. The worst part of all is they misquoted the balance due and I accidentally overpaid them. When I politely requested a refund, they said they considered it a 'tip' of $500 and they are refusing to return it. They also left equipment on my lawn and never returned to pick it up.
DESIRED RESOLUTION: "I would like a refund for the $500 overpayment, and a receipt for the work done."
