COMPLAINT: Richard Klinger, Hamilton, Ohio
"I met with Marvin's Organic Gardens because I wanted to get rid of my zoysia grass. They said my job would be a priority that they'd get to right away. I didn't hear from them for weeks.
"When they did come out, the weather held them up. They would come and work, but only for an hour or two at a time. They had to scoop all the zoysia grass out and bring dirt in. They didn't grade and now there are low spots where water stands.
"I wouldn't want them to do anything again. I called them two or three times and pointed out the low spots. They said they'd come out and take care of it. All they did was put a few wheelbarrow loads of grass seed on it.
"They didn't clean up after themselves and left drink bottles laying around the yard. I'm going to have to have someone come out and do this right."
DESIRED RESOLUTION: "I want $2,500 for the fill dirt [that's] needed."
RESPONSE: Frank Stewart, landscape designer, Marvin's Organic Gardens
"This project was completed on a strictly time and materials basis, which means we'd continue to add soil and grade as long as the member deemed necessary.
"At the time of completion, we met with the customer, discussed that future work may be required due to settling and received final payment.
"In the months after our completion and before the member's report, a major construction project was undertaken on the site and the lawn was significantly damaged by equipment."
STATUS: Stalemate
